٦٥ —Rent—Power of Court to fix.—The Courts have power to fix the rent payable under a contract of hikr in accordance with the actual value of the land. ٦٣ 63. — Construction menaçant ruine — Connaissance du danger par le propriétaire. — Tombe sous le coup de l'art. 202 C.P. comme coupable d'homicide involontaire le propriétaire d'une maison qui, en s'écroulant, a causé la mort des locataires, s'il savait, ou était en mesure de savoir que la maison n'était pas solide, ayant, par exemple, coopéré lui-même à sa construction. ٦٦ —Dangerous building—Owner's knowledge.—The owner of a house which, owing to a defect in its construction, collapsed and thereby caused the death of the tenants, is punishable under art. 202 P.C. for unintentional homicide if he knew or was in a position to know that the house was unsafe, as e.g., from having taken part in its construction. ٦٨ 68. —Grounds admissible—Experts proceedings.—The court cannot admit a fact discovered in the course of expert's proceedings ordered under art. 284 C.C.C.Pr., as a ground for an improbation action nor can the party be permitted to reserve the right to improbate a second time on grounds thus discovered. (Trib. Zagazig, 11 Jan. 1908; No. 75).
٦٩ 69. —Time for taking proceedings.—Improbation proceedings can only be taken while the principal action to which they are incidental is still pending. They cannot be taken during the pendency of a petition for revocation of judgment. The party seeking to improbate in such circumstances is liable to the fine imposed by art. 291 C.C.C.Pr. (App. 19 Nov. 1907; No. 47).

٦٥ 65. — Inscription de faux incident — Délai — Amende. — L'inscription de faux incident ne peut être faite que tant que l'action principale est encore pendante. Elle ne peut pas avoir lieu au cours d'une procédure en requête civile. Celui qui demande à s'inscrire en faux, en pareille circonstance, encourt l'amende édictée par l'art. 291 C.P.C.C. (App. 19 novembre 1907, N° 47).
٦٦ 66. — Moyen de faux — Admissibilité — Expertise. — Un tribunal ne peut pas admettre comme moyen de faux un fait découvert au cours d'une expertise ordonnée en vertu de l'art. 284 C.P.C.C. dans une instance en inscription de faux. La partie ne peut pas non plus se réserver le droit de recourir à une nouvelle inscription de faux en se basant sur des moyens ainsi découverts. (Trib. Zagazig, 11 janvier 1908, N° 75).
٦٧ 67. — Transaction sur l'instance principale — Amende. — Paiement. — Lorsque, dans une instance en inscription de faux incident le demandeur a encouru l'amende prononcée par l'art. 291 C.P.C.C., le fait qu'il y eut ultérieurement transaction sur l'action principale n'a pas pour effet de le décharger de l'obligation de payer l'amende.
