٥٤ —Bailiff.—Authority to receive payment.— The delivery to a bailiff of the documents evidencing a claim for the purpose of enabling him to serve a monition of execution carries with it an implied authority to receive payment of the sum due and to give a valid discharge. ٥٨ —Recruiting Law—Penalties.—Art. 2 of the Decree of Promulgation of the Penal Code (Law No. 3, 1904) which empowers the judge in a case where a law prior to the Penal Code cumulates fine and imprisonment, to impose one of these penalties only, applies a fortiori to a case (such as art. 131 of the Recruiting Law) where the imposition of a fine in addition to imprisonment is optional. ٥٦ 56. — Faux en écriture publique — Procès-verbal de croque-mort. — Un croque-mort (raïs hanut) est, en vertu du décret du 9 novembre 1887, un employé public aux fins de l'art. 181 C.P., et le procès-verbal rédigé par lui en vertu de ce décret est un acte de son ministère. ٥٧ 57. — Faux et usage de faux — Infraction unique. — Constitue une infraction unique le fait, par un même individu, d'avoir falsifié un acte et d'en avoir postérieurement fait usage. (Cass. 14 mars 1908, N° 107, I).
٥٨ 58. — Préjudice — Citation irrégulière dans la forme. — Nullité imprévue de la part de l'agent. — Le commis d'un avocat altéra la date d'une citation en matière civile dans le but d'éviter la perte de certains frais judiciaires payés d'avance. La citation fut faite par une personne commise en vertu de l'art. 11 C.P.C.C., mais la copie ne contenait pas la commission dont la reproduction est exigée par l'art. 12 C.P.C.C. La personne citée comparut sans contester la validité de la citation et jugement fut rendu contre elle. — Le commis de l'avocat, poursuivi pour faux en écriture, invoqua pour sa défense que la citation était nulle, parce qu'elle ne contenait pas la copie de la commission et qu'en conséquence il ne pouvait pas être condamné. — Il fut jugé par la Cour de cassation que l'omission de reproduire la commission d'une personne chargée de faire une citation en conformité de l'art. 12 C.P.C.C., ne rendait pas la citation nulle de plein droit, mais seulement annulable à la requête de la partie citée et qu'en conséquence l'accusé avait été condamné à bon droit. — Jugé, également, par la Cour d'assises, qu'en supposant nulle la citation, l'accusé n'en pourrait pas moins être condamné, attendu que la nullité de la citation n'avait pas été envisagée par lui comme la conséquence de son acte. — Jugé aussi, par le Juge de renvoi, que lorsqu'un acte falsifié est originairement valable, mais devient nul par suite de l'omission d'une formalité subséquente requise par la loi, il y a une possibilité suffisante de préjudice pour constituer un faux punissable. ٦٠ —Official document—" Procès-verbal " of " Raïs Hanut."—Public servant —Undertaker—Forgery.—A Raïs Hanut within the meaning of the Decree of 9th November 1887 is a public servant for the purposes of art. 181 P.C., and the procès-verbal drawn by him under that Decree is a document drawn up in his official capacity. (Cass., 29 June 1907; No. 6).
٦١ —Prejudice—Summons irregular in form—Nullity not contemplated by accused.—An advocate's clerk altered the date in a summons in a civil action with intent to avoid the forfeiture of certain judicial fees paid in advance. The summons was served by a person appointed under art. 11 C.C.C.Pr. but the copy did not contain the record of the appointment required by art. 12 C.C.C.Pr. The party served appeared in the action without objecting to the validity of the summons and judgment was given against him. In a prosecution of the advocate's clerk for forgery of the summons, the defence was raised that the summons was void by reason of the omission to record the appointment and that consequently the accused could not be convicted. Held, by the Court of Cassation, that the omission to record the appointment of the person serving the process under art. 12 C.C.C.Pr. did not render the summons void ab initio but merely voidable at the instance of the party served and that the accused was rightly convicted. Held, also, by the Assize Court, that assuming the summons to be void, the accused could nevertheless be convicted in view of the fact that the nullity had not been contemplated by him as a result of his act. Held, further, by the Committing Magistrate, that when a falsified instrument is originally valid but becomes invalid by reason of the omission a subsequent formality required by law, there is a sufficient possibility of prejudice to constitute the offence of forgery. C., means, not only such deception as concerns the very nature of the wares, e.g. when brass is sold as gold, but also deception as to any of their essential qualities, e.g. when a modern statue is sold as antique. ٦١ 61. — Possession par copropriétaire du débiteur gagiste. — Un créancier gagiste dont le gage avait pour objet une part indivise d'un immeuble convient avec le copropriétaire de son débiteur, que celui-là resterait en possession du bien en son nom, et lui remettrait la part des fruits revenant au débiteur. Le créancier intenta une action en paiement de cette part et des fruits contre le débiteur et contre le copropriétaire. — Il a été jugé qu'en l'absence d'autres créanciers, la possession de l'immeuble dans cette forme était régulière et que le gage était valable. ٦٣ — Private club.— A person who keeps a club in which games of chance are played is not guilty of an offence under art. 307 P. C., so long as entrance to the club premises is restricted to subscribing members who have been admitted to membership in accordance with the club rules. A club is not a public establishment within the meaning of Law No. 1 of 1904 unless it is open to the public, notwithstanding the mention of "clubs" in art. 1 of that law. (Cass., 27 April 1907; No. 3).

٦٤ — Contract of sale — Express gift of price — Validity.— Art. 48 C.C. does not require that a gift made otherwise than by official instrument should be simulated, but merely that the gift should assume the form of some other contract. A gift made in the form of a contract of sale is not, therefore, bad, although the donor expressly declares in the contract that he makes a gift of the price to the donee, and it is, therefore, evident that the sale is fictitious. (App. 17 Feb. 1907; No. 87).
