٤٢ 42. — Arbres — Nombre — Inculpation. — Le paragraphe 3 de l'art. 321 C.P. d'après lequel le fait d'abattre un ou plusieurs arbres constitue un délit, ne s'applique pas au cas où il y a eu abatage d'un grand nombre d'arbres (par exemple, 112). Ce dernier fait tombe sous l'application du paragraphe 1 du même article et, lorsqu'il est accompagné des circonstances aggravantes mentionnées dans l'article 322 C.P., il constitue un crime. ٤٣ — Trees—Extent of damage—Charge.—Section (3) of art. 321 P.C. under which the cutting down of one or several trees is punishable, as a misdemeanor, does not apply to the destruction of a great number of trees (e.g. 112). The latter act is within section (1) of the said article, and, when accompanied by the aggravating circumstances mentioned in art. 322 P.C., constitutes a crime. (Trib. Cairo 11 March 1908; Sum. ٤٤ 44. — Justification — Nouvelle fournie par un tiers. — Le propriétaire d'un journal, poursuivi pour diffamation, ne peut invoquer pour sa défense, qu'il tenait d'un tiers la nouvelle par lui relatée dans son journal. (Cass. 28 mars 1908 ; N° 70, I).
٤٥ 45. — Mauvaise foi — Présomption. — Un acte illicite en lui-même, tel que la publication de propos injurieux à l'égard d'un tiers, fait présumer en droit et en fait la mauvaise foi vis-à-vis de ce tiers, c'est-à-dire l'accomplissement de l'acte avec l'intention de lui voir produire toutes ses conséquences normales. Il n'est donc pas nécessaire d'établir, en ce cas, dans les poursuites l'existence effective de la mauvaise foi. (Cass. 28 mars 1908, N° 70, III).

٤٤ —Implicit election—When the domicil mentioned in the process of service of a judgment as that of the party in whose behalf service is effected is not his true domicil, there is an implicit election of domicil for service of all processes, such as a petition for revocation, which arise out af the judgment. ٤٨ 48. — Forme de vente — Donation expresse du prix — Validité. — L'art. 48 du Code civil n'exige pas qu'une donation qui n'est pas faite par acte authentique soit dissimulée, mais seulement que la donation revête la forme d'un autre contrat. Une donation faite sous la forme d'un contrat de vente n'est, en conséquence, pas nulle bien que le donateur déclare expressément dans le contrat qu'il fait donation du prix et, qu'en conséquence, il est évident que la vente est fictive. ٤٩ 49. — Conseil provincial — Eligibilité — Paiement de l'impôt foncier. — Pour établir qu'une personne est éligible à un conseil provincial, en vertu de l'art. 14 de la loi organique, comme ayant payé depuis deux ans au moins cinq mille piastres par an d'impôt foncier, il n'est pas nécessaire de prouver qu'il avait la propriété des terres par rapport auxquelles l'impôt avait été payé ni que l'impôt s'appliquait à deux années entières. ٤٧ — Alcoholic liquors—Licensee. — When alcoholic or fermented liquors are sold in a public establishment, the person who, under art. 12, Public Establishments Law (No. 1, 1904) must hold a special personal licence, is the tenant of the establishment and not the director or manager. ٤٨ —Commencement of written proof—Statement in Court.—A statement made at the hearing of an action by one of the parties is equivalent to a commencement of written proof against such party. (Trib. Alexandria, 17 Feb. 1908; No. 105).
٤٩ — Creditor exercising debtor's right of action.—A creditor exercising his debtor's right of action is in precisely the same position as the latter. If, therefore, the debtor could not have employed a particular method of proof, the creditor cannot do so. (Trib. Assiout, 30 Oct. 1907; No. 62).
٥٠ —Document, authenticity of — Weight of evidence.—The facts relied on to establish the forgery of a document must be such that, if they are proved, the falsity of the document is a necessary result. The improbability that a document represents the true intention of the party or the fact that the person who drafted it is unknown are not sufficient, if proved, to establish a forgery.
