١٠٨ 108.—Law of Said Pasha, art. 7—Male heir—Infirmity.—The male heir of a pensioner under the Pension Law of Said Pasha who is of more than fifteen years of age has, by virtue of article 7 of that Law, the same rights to pension as a male heir under fifteen if he is afflicted with an infirmity rendering him unable to earn a livelihood, notwithstanding the fact that his means are sufficient to enable him to live without employment. ١١٠ 110.—Possession by co-owner of pledgor.—The pledgee of an undivided share in an immovable agreed with his debtor's co-owner that the latter should remain in possession on his behalf and pay him the pledgor's share of the profits. In an action brought against the pledgor and the co-owner by the pledgee for payment of the share :— Held, that, in the absence of competing creditors, the pledgee might properly take possession of the immovable in this manner and that the pledge was valid. ١١١ 111.—Judgment by default on appeal — Opposition.—Art. 17 of the Pre-emption Law of 1901 is a bar to opposition to a judgment on appeal in a pre-emption suit no less than to opposition to a judgment in first instance. (App. 26 Jan. 1908 ; No. 111).
١١٢ 112.—Partial pre-emption—Rights of parties.—Upon a sale of land it was provided by the deed of sale, in which a hypothecary creditor joined, that the sum secured by the hypothec and a portion of the purchase money should remain outstanding. It was further provided that, upon a re-sale of any portion of the land, the land re-sold should be released from the hypothec upon payment of a proper proportion of his debt to the hypothecary creditor. There was a like provision as to the vendor's lien. The owner of land contiguous to a portion of the land sold claimed the right to pre-empt such portion as being entitled to a right of servitude over it. The original purchasers resisted the claim on the sole ground that the right of servitude did not exist. In this contention they failed. Held: 1.—That, as neither the vendor nor the purchasers had raised the objection that the right of preemption is indivisible, the pre-emptor was entitled to succeed. 2.—That, for determining the rights of the parties inter se, the pre-emptor must be treated as an independent purchaser of his portion of the land with all the rigthts of the original purchasers other than that to have the payment of a part of the purchase money postponed. 3.—That, upon payment of the proper parts of the purchase money to the vendor and the hypothecary creditor respectively, the pre-emptor was entitled to have his land released from the vendor's lien and from the hypothec. ١١٣ 113.— Re-sale to vendor — Right of pre-emptor — Transcription of declaration.— The vendor of an immovable who re-purchases is not, as against a pre-emptor, a third party and cannot, therefore, deprive a pre-emptor of the right to pre-empt on the ground that the document of re-purchase was transcribed before the transcription of the declaration of intention to pre-empt. (Summ. Trib. Mit Ghamr, 7 May 1908 ; No. 130).
١١٤ 114.—Service of process out of time—Fraud of party to be served.—The process instituting pre-emption proceedings must be served both upon the vendor and upon the purchaser within the time fixed be art. 15 of the Decree of 23rd March 1901, under pain of forfeiture. But the right of pre-emption is not lost when the failure to serve one of the parties within the legal period has been caused by his own fraud. (App. 24 March 1907; No. 15).

Il était stipulé, en outre, qu'en cas de revente d'une partie quelconque de l'immeuble, la partie revendue serait quitte et libre de l'hypothèque moyennant le paiement fait au créancier hypothécaire d'une part proportionnelle de sa créance. Le contrat contenait une disposition semblable concernant le privilège du vendeur. Le propriétaire d'un immeuble contigu à une partie de l'immeuble vendu demandait à préempter cette partie en vertu d'un droit de servitude. Les premiers acheteurs s'opposèrent à la demande en se basant uniquement sur l'inexistence du droit de servitude, moyen qui a été reconnu mal fondé. Il a été jugé, sur ces faits : 1° Que, puisque ni le vendeur ni les acheteurs n'avaient invoqué l'indivisibilité du droit de préemption, il y avait lieu de donner raison au demandeur ; 2° Que pour établir les droits des parties entre elles, il fallait considérer le préempteur comme acheteur pur et simple de la partie préemptée et comme ayant tous les droits des acheteurs primitifs, hormis celui de retarder le paiement du prix : 3° Que, moyennant le paiement au vendeur et au créancier hypothécaire des parts proportionnelles du prix, le préempteur avait droit à la propriété du terrain préempté entièrement quitte et libre du privilège du vendeur ainsi que de l'hypothèque. ١٠٧ 107. — Rachat — Droits du préempteur — Transcription de la déclaration. — Le vendeur qui a racheté l'immeuble vendu n'est pas un tiers par rapport à un préempteur et ne peut, en conséquence, priver ce dernier de son droit en se fondant sur ce que l'acte par lequel il a racheté l'immeuble a été transcrit avant la transcription de la déclaration de l'intention de préempter. Mit-Ghamr — N° 130١٠٨ 108. — Signification tardive de l'acte introductif — Fraude de la personne à laquelle la signification est faite. — L'acte d'huissier introduisant une demande en préemption doit, à peine de déchéance, être signifié et au vendeur et à l'acheteur dans le délai mentionné dans l'art. 15 du décret du 23 mars 1901. Néanmoins le préempteur n'est pas déchu de son droit pour le motif que l'une de ces personnes n'a pas été citée dans le délai légal, lorsque c'est la fraude de cette dernière qui en est la cause. ١٠٩ 109. — Interruption — Citation devant un tribunal incompétent. — La prescription acquisitive est interrompue par la citation en justice même devant un tribunal incompétent, notamment devant les tribunaux mixtes, lorsque toutes les parties étaient indigènes. (App. 27 avril 1907, N° 60).

١١١ 111. — "Dies a quo" — Usage de faux — Pièces présentées dans une action civile. — Une pièce présentée dans une action civile fut jugée fausse en dernier ressort par un jugement d'appel. Le délai de la prescription de l'action publique pour usage de la pièce fausse commence à courir de la date du jugement d'appel. (Cass. 27 avril 1907, N° 4).
١١٢ 112. — Jugement par défaut — Signification après délai de la prescription — Opposition. — Lorsqu'un jugement de condamnation par défaut en matière délictuelle a été signifié après l'expiration d'un délai de trois ans à partir de son prononcé et qu'opposition est régulièrement faite par le prévenu, le jugement ne doit être considéré que comme le dernier acte de la procédure, et en conséquence, l'action publique est prescrite en vertu de l'art. 279 C.I.C. ١١٨ 118.—"Dies a quo"—Uttering a forgery—Document produced in civil action.—A document relied upon in a civil suit was finally decided to be a forgery by a judgment on appeal. The period of prescription of the public action in respect of the offence of uttering the forged document commences to run from the date of the judgment on appeal. (Cass., 27 April 1907 ; No. 4).
١١٩ 119.—"Last proceedings" — Judgment by default — Opposition after period of prescription.—When a judgment convicting by default for misdemeanour is served after the expiration of three years from its date and opposition is duly made by the accused, the judgment becomes merely the last proceeding in the investigation and the prosecution becomes barred by virtue of art. 279 C.Cr.Pr. (Trib. App. Tanta, 1 March 1908; No. 55, I).

١١٥ 115.—Interruption—Suit in wrong Court. Acquisitive prescription is interrupted by service of a summons, even though the Court in which the action is commenced has no jurisdiction to hear the case, as, e.g. when a suit to which all the parties are natives is commenced in the Mixed Courts.
