المبادئ المستخلصة
(١) الاستدانة لأمر ضرورى مثل تشييد مقبرة لاتستوجب الحجر على المقترض لأنها لاتدل على سوء التصرف . (٢) ليس من الواجب ايقاف السير فى دعوى الحجر عند وفاة طالب الحجر لأن قانون المجالس الحسبية لم يرد فيه نص على ذلك .

DAME HASSENKAR ABDALLA v. MOHAMMAD KAMAL EL MINASTIRLY BEY AND ANOTHER. I. Meglis Hasby — Interdiction on ground of prodigality—Loan—Effect. II. Meglis Hasby — Interdiction — Death of the petitioner for interdiction — Effect. I. The fact that a person has borrowed money with view to meet an urgent necessity such as the construction of a tomb, does not justify his interdiction on ground of prodigality. II. The death of a person who has presented to the Meglis Hasby a petition for interdiction against another person, shall not have for effect to let the Meglis put off its decision upon the petition aforesaid, as the laws relating to Meglis Hasbys do not contain any text ad hoc.

DAME HASSENKAR ABDALLA contre MOHAMMED KAMAL EL MANASTERLI BEY ET AUTRE. I. Méglis Hasby — Interdiction pour cause de prodigalité — Emprunt — Effet. II. Méglis Hasby—Interdiction—Décès du demandeur de l'interdiction — Effet. I. Le fait par une personne d'emprunter de l'argent pour parer à un besoin urgent comme la construction d'une tombe, ne saurait justifier l'interdiction de l'emprunteur pour cause de prodigalité. II. Le décès de la personne qui a présenté au Méglis Hasby une demande en interdiction, ne saurait avoir pour effet de surseoir à la décision du Méglis sur la dite demande, les lois relatives aux Méglis Hasbys étant dépourvues d'un texte adéquat.
