ليست المجالس البلدية فروعا من الحكومة ولا تابعة للادارة رغم ما للحكومة عليها من الاشراف فهى أشخاص معنوية ذات شخصية مستقلة ومصالح منفصلة عن الحكومة . ومن ثم فلا يسرى قبلها دكريتو ١٨ مايو سنة ١٨٩٢ الذى جعل الاختصاص فيما يتعلق بقضايا الحكومة سواء كانت لها أو عليها لمحاكم معينة .

TRIBUNAL OF BENI SUEF. 18 MARCH 1922. MM. Muhammad Fouad Hosny Bey (Pres.); Hussein Zaky Bey, Aly Muhammad Hussein Bey (JJ.). SALEH BEY FAREED v. MINYA MUNICIPAL COUNCIL. Municipalities - - Distinct moral persons - Effect as to jurisdiction of Courts. Municipalities do not form a part of the Government and are not dependent of the Administration, although they are submitted to an administrative control. They constitute moral and independent persons who have distinct interests. Consequently, they are not governed by the Decree of May 18, 1892, which empowers, as regards jurisdiction, certain courts to try the cases instituted by or against the Government.

TRIBUNAL DE BENI SOUEF. 18 MARS 1922. MM. Fouad Hosni Bey (Prés.); Hussein Zaki Bey, Ali Mohammed Hussein Bey (JJ.). SALEH BEY FARID contre COMMISSION MUNICIPALE DE MINIEH. Municipalités — Personne morale indépendante du Gouvernement — Effet quant à la compétence. Les municipalités ne font pas partie du Gouvernement et ne dépendent pas de l'Administration, malgré le contrôle administratif auquel elles sont soumises. Elles constituent des personnes morales indépendantes, ayant des intérêts distincts et par suite elles ne sont pas régies par le Décret du 18 mai 1892 qui attribue la compétence en ce qui concerne les procès intentés par ou contre le Gouvernement, à certains tribunaux déterminés.
