المبادئ المستخلصة
اذا وصفت المحكمة حكما بأنه حضورى مخالفة للواقع فعارض فيه المحكوم ضده ولكنه استأنفه فى آن واحد خشية أن لا تقضى المحكمة الابتدائية بقبول المعارضة ثم ظهر بعد ذلك أن المعارضة قبلت فيصبح الاستئناف غير مقبول ذلك لأنه رفع عن حكم يجوز أن تغيره المحكمة الابتدائية ولأنه لا يشمل تاريخ الحكم فى المعارضة ولا موضوع ذلك الحكم . ومن الواجب لأجل أن يكون الاستئناف مقبولا أن يرفع عن الحكم الذى يصدر فى المعارضة .

Civil procedure—Appeal and opposition at the same time—Admissibility of the opposition—Effect. Where subsequently to a judgment by default, which has been erroneously qualified by the court as contradictory, the party against whom it was given, has made opposition and at the same time lodged appeal thereto, the appeal in the event when the opposition is validly received, should be dismissed; as, on one side, the judgment attacked may be modified by the court of first resort and, on the other side, the appeal cannot be lodged as long as it has not been finally decided upon the opposition.

ADMINISTRATION DU WAKF SULTANIEN contre LES HÉRITIERS DE MOHAMMED MOSSALLEM ET AUTRES. Procédure Civile—Appel et opposition en même temps—Recevabilité de l'opposition—Effet. Si à la suite d'un jugement qualifié à tort par le tribunal comme contradictoire, le condamné a formé opposition et interjeté en même temps appel contre le dit jugement, l'appel, doit en cas de recevabilité de l'opposition, être rejeté, étant donné d'une part que le jugement attaqué peut être modifié par le tribunal du premier degré et que l'appel ne saurait être interjeté tant que l'opposition n'a pas été vidée.
