التعاقد مع الشخص المطلوب الحجر عليه أمر مشكوك فى صحته وللمحكمة الحق فى تقدير صحة هذا التعاقد وسلامة نية المتعاقد فى ذلك ومراعاة مصلحة المتعاقد .

(Page 114) COURT OF APPEAL. 25 DECEMBER 1922. MM. Mohammad Mehrez Pasha (Pres.); Caloyanny, Mohammad Allam Pasha (JJ.). EL SHEIKH MOHAMMAD SULAIMAN v. MOSTAFA EFFENDI KAMEL MOSTAFA. Interdiction—Contracts concluded in course of proceedings thereof—Effect. Agreements concluded with a person against whom proceedings for interdiction are taken, arouse suspicion. The validity of contracts stipulated in such circumstances, depends upon the appreciation of the court, which, for this purpose, should take consideration of the good faith of the party who has contracted with the interdicted person, as well as the benefit of this latter.
