المبادئ المستخلصة
(١) لا يجوز بعد رفع الدعوى أمام الجهة المختصة أن يغير أحد الخصمين ذلك الاختصاص باعتناقه مذهبا جديدا . (٢) لا يجوز أن يطلب من المجلس الحسبى فى حالة تغيير شخص لصفته المذهبية أو الدينية أن يتبع اجراءات من شأنها التثبت من عقيدة الشخص الداخلية وعما اذا كان هذا التغيير حصل عن يقين ثابت أو هو لأجل الخديعة والتحايل اذ ليس للمجالس أن يخرج شخصا بغير رضاه من مذهب أثبت اعتناقه له . (٣) توقيع الحجر قرار فاصل فى موضوعه بالنسبة للجهة التى أصدرته فطلب اعادة النظر فيه دعوى جديدة ولو أنها تتعلق بالنظر فى القرار السابق وتكون هذه الدعوى من اختصاص الجهة التى تتبعها شخصية المحجور عليه وقت رفعها دون أن يكون لشخصيته وقت الحجر تأثير فى ذلك ومن ثم فللمجالس الحسبية أن ترفع حجرا أوقعه المجلس الملى متى أصبح الاختصاص لتلك المجالس .

Competent jurisdiction—Meglis Hasby—Competence—Change of Status in cause of procedure. II. Meglis Hasby—Competence—Religious conversion—Effect. III. Meglis Hasby—Competence as to interdiction and removal thereof. I. Where a suite has been regularly brought before a competent juridiction no one of the parties in dispute may, by his proper act avoid such juridiction by changing, for instance, his personal or religious status. II. Where an Elam Charé, is produced to the Meglis Hasby by an individual, stating that he has been converted to Mohammadan religion, the Meglis Hasby cannot interfere with the merits thereof in order to verify if the conversion is sincere or not: the Meglis, in fact, has no power to exclude a person, in dispite of himself, from a religion, which he embraced, if it is legally established that he was duly converted thereto. III. A decision for interdiction puts end to the dispute relating thereto as regards the jurisdiction which has rendered the said decision. Consequently, a petition for the removal of interdiction should be considered as a new and separate procedure although it relates to a prior decision. Such petition, therefore, should be introduced before the jurisdiction to which the interdicted person belongs, at the time of interdiction, without taking any consideration of the previous quality of this latter. Juridiction complètement saisie—Méglis Hasby—Compétence—Changement d'état. II. Méglis Hasby—Compétence—Conversion religieuse—Effet. III. Méglis Hasby—Compétence quant à l'interdiction et sa mainlevée. I. Lorsqu'une action a été régulièrement introduite devant la juridiction compétente, aucune des parties en cause ne saurait, par son propre fait, se dérober à cette compétence moyennant par exemple changement de son état personnel ou religieux. II. En présence d'un Elam Charé produit au Méglis Hasby par une personne, constatant qu'elle s'est convertie à l'islamisme, le Méglis ne saurait procéder à la vérification de la sincérité de cette conversion, étant donné qu'il ne lui appartient pas d'éclure une personne, malgré soi, de la religion à laquelle il est légalement établi qu'elle s'est convertie. III. La décision d'interdiction épuise le litige qui se rapporte à cette question, quant à la juridiction qui l'a rendue. Par conséquent, une demande de mainlevée d'interdiction doit être considérée comme une nouvelle instance, quoi qu'elle se rattache à une décisio antérieure et partant, elle doit être portée par devant la juridiction dont relève l'interdit au moment où elle fut introduite, sans tenir aucun compte de la qualité antérieure de celui-ci. Ainsi, les Méglis Hasbys peuvent ordonner la mainlevée d'une interdiction par un Méglis Melli. Cette décision fut confirmée par Méglis Hasby Supérieur, mars 2, 1918. Voir Appel, mars 3, 1907 (B.O.
