المبادئ المستخلصة
اذا حكم لشخص برسو مزاد أرض فزرعها وهو معتقد أن له الحق فى ذلك بسبب حكم مرسى المزاد ثم حكم بعد ذلك برسو مزادها لآخر كان لمن رسى عليه المزاد الأول الحق فى مطالبة الثانى بنفقات الزراعة التى زرعها .

COURT OF APPEAL. 14 DECEMBER 1922. MM. Ahmad Zaky Aboul Seoud Bey (Pres.); Hill, Aly Galal Bey (JJ.). ABDEL AZIZ GOM'A BEY v. MOHAMMAD SUSSA PASHA. Obligation created by an act—Purchaser by adjudication—Cultivation in good faith—Recourse against a new purchaser. Whereas a purchaser by adjudication has cultivated the land adjudicated, at a time in which he considered himself as owner thereof, on account of the judgment of adjudication, such purchaser has, in case when the land is subsequently sold by adjudication to another purchaser, the right to have the fees and expenses relating to cultivation refunded by this latter.

Obligations résultant du fait—Adjudicataire ayant cultivé de bonne foi—Droits vis-à-vis du nouvel adjudication. L'adjudicataire qui après avoir cultivé le terrain à lui adjugé, à un moment où il se considérait comme propriétaire, en vertu du jugement d'adjudication, aura, dans le cas où le terrain viendrait à être adjugé à un nouvel adjudicataire, le droit d'être indemnisé par celui-ci pour les frais et dépenses de la culture.
