المبادئ المستخلصة
(١) الأحكام الجنائية التى أصبحت نهائية يجب أن يكون لها قوة الشىء المحكوم فيه من جهة ادانة المتهم أو براءته ومن جهة الوقائع الثابتة بها والتى تكون مع منطوق الحكم بالادانة أو البراءة وحدة غير قابلة للتجزئة ولذلك فانه ليس للمحاكم المدنية اذا رفعت أمامها دعوى مدنية ممن وقعت عليه جريمة بطلب تعويض الضرر الناشىء عن الجريمة المحكوم فيها بالعقاب من المحاكم الجنائية أن تبحث من جديد فى ثبوت التهمة على المدعى عليه من عدمه بل هى مقيدة بقوة الشىء المحكوم فيه جنائيا وكذلك ليس لها أن تبحث فى حالة الحكم بالبراءة اذا كان المتهم بريئا أم لا (١) . (٢) يجب فيما يختص بالنتائج القانونية والعملية المترتبة على تطبيق مبدأ تقييد المحاكم المدنية بقوة الشىء المحكوم فيه من المحاكم الجنائية أن تفصل بين الأحكام الصادرة بالادانة والأحكام الصادرة بالبراءة فالحكم بالادانة هو والأسباب التى بنى عليها مقيد للقاضى المدنى الذى تطرح أمامه دعوى التعويض تقييدا لا يقبل جدلا فى كون الواقعة ارتكبت وأن المتهم هو المرتكب لها وأن الفعل يعاقب عليه قانونا . أما أحكام البراءة فانها وان تكن مقيدة للقاضى المدنى فيما يختص ببراءة المتهم الا أنها فيما يختص بتأثيرها على الدعوى المدنية يجب أخذها مرتبطة بأسبابها غير المنفصلة عنها ولذلك فانه يختلف تأثير حكم البراءة على الدعوى المدنية فيما يختص بقوة الشىء المحكوم فيه باختلاف تلك الأسباب فاذا ذكر فى أسباب البراءة أن الجريمة لم تقع أو أنها وقعت ولكن لم يرتكبها المتهم يكون للحكم الجنائى بالبراءة قوة الشىء المحكوم به فى الدعوى المدنية المقامة أمام القاضى المدنى ويكون حكما لا يقبل الجدل بأن الجريمة لم تقع أو أنها وقعت ولكن لم يرتكبها المتهم أما اذا كان حكم البراءة مبنيا مثلا على وجود أسباب قانونية لاعفاء المتهم من العقوبة أو على سبب عدم توفير أركان الجريمة فان الحكم بالبراءة لا يمنع جواز النظر فى التعويض المدنى (٢) . Res judicata in criminal matters— Effect as to civil claims. II. Res judicata in criminal matters— Effect as to civil claims—Distinction between sentences of conviction and those of acquittal. I. Final sentences given by the criminal courts have the force of res judicata, as regards the culpability or the non-culpability of the accused as well as the facts established therein which relate to the operating part of such sentences. Thus, where the criminal court has rendered in a criminal case a final sentence of acquittal or conviction, the civil tribunal before which the victim has subsequently brought a claim to repair the prejudice suffered, cannot deal with the merits of such sentence and decide if the respondent was guilty or not guilty; the civil tribunal in such case, being bound by the force of res judicata (1). II. As regards the legal and practical results of applying the principle that res judicata in criminal matters is binding on the civil courts, a distinction must be made between sentences of conviction and those of acquittal. In the first instance, the sentence and the reasons upon which it is based bind the civil court, before which the claim of damages is brought, in such a manner that this court must admit the culpability of the accused and the criminality of the facts set forth therein. In the second case, although the sentence of acquittal should bind the civil court, with regard to the non-culpability of the accused, such sentence, however, should be taken into consideration combined with the reasons upon which it is based and which form an inseparable part thereof. Thus, the effect of acquittal on the civil claim differs, from the point of view of res judicata, according to the reasons upon which the sentence is based, if these reasons prove that there was no offence to law or that the accused is not guilty of a certain offence which has been committed, the sentence of acquittal shall have the force of res judicata with respect to the civil claim introduced before the civil court and should be considered as an unquestionable argument as regards the fact that there was no offence or, if there was any, that it has not been committed by the accused. But if the sentence of acquittal is based upon a ground of justification, an exculpatory circumstance, or on the absence of an element of the offence, such sentence does not constitute a bar to examining and appreciating the civil claim (2). Les sentences définitives des tribunaux de répression ont la force de chose jugée tant en ce qui concerne la culpabilité ou la non-culpabilité, qu'en ce qui concerne les faits y constatés qui se rattachent au dispositif. Par conséquent, lorsque pour une infraction à la loi pénale, le tribunal répressif a rendu une sentence définitive de condamnation ou d'acquittement, le tribunal civil qui, dans la suite, a été saisi d'une action introduite par la victime pour obtenir réparation du préjudice subi, ne saurait rechercher de nouveau si l'intimé (défendeur) est ou n'est pas coupable, le dit tribunal étant lié en pareil cas par l'autorité de la chose jugée.(1) II. Pour les résultats juridiques et pratiques de l'influence de la chose jugée au criminel sur le civil, une distinction s'impose entre les sentences de condamnation et les sentences d'acquittement. Dans le premier cas, la sentence avec ses motifs doit lier le tribunal civil, saisi de l'action en paiement des dommages-intérêts, de telle sorte qu'il ne saurait plus admettre de doute sur l'existence de l'infraction, la culpabilité de l'accusé et la criminalité des faits invoqués. Dans le deuxième cas, les sentences d'acquittement, bien qu'elles doivent lier le juge civil quant à la non-culpabilité du prévenu, cependant, elles doivent, en ce qui concerne leurs effets sur l'action civile, être rattachées aux motifs dont elles procèdent et dont elles ne sauraient être séparées, pour être ainsi prises en considération. Ainsi, l'effet de l'acquittement par rapport à l'action civile, varie au point de vue de la force de la chose jugée suivant les motifs. Si donc, ces motifs établissent l'absence de toute infraction ou la non-culpabilité du prévenu relativement à une infraction ayant eu lieu, la sentence d'acquittement aura force de chose jugée par rapport à l'action civile instituée par devant le tribunal et sera considérée comme un argument indiscutable sur le fait qu'il n'y a pas eu infraction ou que, celle-ci ayant eu lieu, le prévenu n'en est pas l'auteur. Si par contre, le jugement d'acquittement est motivé par l'existence des circonstances justificatives ou absolutoires ou par le défaut d'un des éléments de l'infraction, la sentence d'acquittement ne saura faire obstacle à l'examen et à l'appréciation de l'action civile.(2) (1) Voir App. 21 avril 1903 (O.B.
