المبادئ المستخلصة
انه وان كانت المادتان ١٣٤ و ١٣٥ من القانون التجارى تقضيان بأنه لأجل تحويل الكمبيالات يلزم أن يذكر بها عبارة (ان القيمة وصلت) والا كان التحويل توكيلا بالقبض لكنه ليس من الضرورى ذكر هذه الألفاظ بالنص بل يكفى لاثبات تنازل المحيل عن ملكية الكمبيالة أن يتضمن التحويل عبارات أخرى تفيد التنازل عن الملكية كما اذا ذكر فيه مثلا (وليس لى الحق فى الكمبيالة) .

TRIBUNAL OF TANTA. 4 MARCH 1923. MM. Muhammad Hamdy El Sayed Bey (Pres.); Kamel El Baraty Eff., Ahmad Hamdy Mahboob Eff. (JJ.). EL SHEIKH GABR MUSSA'ED HETATA v. EL SHEIKH AHMAD YOUSSEF FAYED. Bill of exchange—Indorsement—Conditions.—(Arts. 134 and 135 Com. C.). Although Articles 134 and 135 Com. C. require that the indorsement must state that " value has been received," otherwise it does not effect the transfer and is only a procuration for collection, it is not, however, indispensable to use exclusively the words " value received." In order that the indorsement may effect the transfer, it is sufficient that the ransfer of the property is therein stated by any other equivalent term, as for example " the bill of exchange does not belong to me."

Lettre de change—Endossement—Conditions.—(Arts. 134 et 135 C. Com.). Bien que les articles 134 et 135 C. Com. exigent que l'endossement spécifie que la "valeur a été reçue" sous peine de ne pas opérer le transport, et de ne valoir que comme simple procuration pour le recouvrement, il n'est cependant pas indispensable d'employer exclusivement les mots "valeur reçue." Il suffit pour que l'endosssement produise son effet, que le transport y soit exprimé au moyen de toute autre mention équivalente, comme par exemple " La lettre de change ne m'appartient plus."
