COURT OF APPEAL 23 December 1902. MM. Saad Zaghloul Bey (Pres.); Halton, Perry (JJ.). PRINCESSES GUNANIAR HANEM AND GASHM AFAT HANEM v. PRINCE HUSSEIN PASHA KAMEL AND OTHERS (C.C. Arts 47, 611) Eshhad (Declaration)—Turkish Mehkemeh—Immovable situated in Egypt—Transcription. An Eshhad made before a Mehkemeh in Turkey by the owner of an immovable situated in Egypt to the effect that another person is the owner thereof constitutes, provided there is acceptance either express or tacit on the part of the latter, a deed capable of conveying ownership, and consequently is not established as against third parties unless transcribed in Egypt.

Un echhad (déclaration) fait devant un mehkémé turc par le propriétaire d'un immeuble situé en Égypte, et contenant la déclaration qu'une autre personne est le propriétaire de cet immeuble, constitue moyennant acceptation expresse ou tacite de cette dernière, un acte translatif de propriété immobilière et, par conséquent, n'est établi vis-à-vis des tiers que par la transcription de l'acte effectuée en Égypte.
