المبادئ المستخلصة
أولا عدم التنويه فى محضر الجلسة بأن المتهم سئل عن اسمه ولقبه الخ ليس وجها للبطلان موجبا للنقض ثانيا — بطلان الاجراآت الذى يحصل امام المحكمة الابتدائية يزول بسكوت ذى الشأن عنه فى الدرجة الاستئنافية فعدم التنويه فى محضر جلسة محكمة أول درجة بان هذه الجلسة كانت علنية ليس فيه بطلان موجب للنقض اذا كان الطالب لم يتمسك بهذا البطلان امام الدرجة الاستئنافية (١) ثالثا — الحكم القاضى بعقوبة الحبس نظير جريمة التزوير واستعماله مع بيان تاريخ الاستعمال لايكون قابلا للنقض بسبب عدم بيان الواقعة التى استدعت العقوبة بيانا كافيا بان ترك التاريخ الذى ارتكب فيه المحكوم عليه التزوير (٢) رابعا — لانص فى القانون يمنع القاضى الذى اشترك فى حكم مدنى قضى بابعاد ورقة باعتبار أنها مزورة كانت قدمت فى القضية من أن يحضر بعد ذلك فى قضية جنائية وأن ينظر فيما اذا كان اصطناع هذه الورقة يعد تزويرا يعاقب عليه القانون وذلك لان الحكمين يختلفان موضوعا (١) يراجع حكم النقض فى ١٧ ابريل سنة ١٨٩٧ (القضا سنة ٤ صحيفة ٣٠٢ وحكم النقض فى ٩ مايو سنة ١٨٩٦ (القضا سنة ٣ صحيفة ٢٢٧ وحكم النقض فى ٢ مايو سنة ١٨٩٦ (القضا سنة ٣ صحيفة ٢٢٦) (٢) قد بنت محكمة النقض والابرام حكمها هذا على كون التاريخ المذكور فى الحكم المطعون فيه كافيا فى اثبات عدم سقوط الحق بمضى المدة فى اقامة الدعوى نظير استعمال التزوير ويؤخذ من حكمها أن المتهم لم يكن له أدنى مصلحة فى اثبات سقوط الحق بمضى المدة فيما يختص بالتزوير انظر عكس ذلك فى حكم محكمة النقض والابرام الصادر فى ٢ مارس سنة ١٩٠١ بالمجموعة الرسميه سنة ٣ صحيفة ٩٠ والتعليقة) فقد قضى هذا الحكم بأن ذكر تاريخ التزوير مازال ضروريا حتى لوكان الحكم الصادر بالعقوبة غير مقصود به الا استعمال التزوير وتراجع تعليقة النقض فى ١٠ مارس سنة ١٩٠٠ (المجموعة الرسمية سنة ١ صحيفة ٢١٥) فيما يختص بمسألة الارتباط الذى بين التزوير واستعماله من حيث الوجهة العموميه

STATE REPRESENTATIVE (I.—C.Cr.Pr. Art. 220; II.—C.Cr.Pr. Art. 220; III.—C.Cr.Pr. Art. 220; IV.—C.Cr.Pr. Art. 220). I.—Cassation—Substantial nullity—Procès-verbal of sitting—Mention; II.—Cassation—Substantial nullity—Nullities in first instance; III.—Cassation—Substantial nullity—Forgery—Uttering a forgery—Dates—Mention; IV.—Cassation—Substantial nullity—Composition of the Court—Civil action—Penal action. I.—The procès-verbal of a sitting which omits to state that the accused was asked his name and address, does not render the judgment liable to cassation for substantial nullity. II.—All nullities arising in first instance are covered by silence on appeal; the omission, therefore, to mention in the procès-verbal of the sitting of a Tribunal of First Instance that the sitting was public does not constitute a nullity giving recourse to cassation, if the nullity has not been brought forward on appeal. (1) III.—A judgment containing a single sentence for forgery and for uttering a forgery and giving the date of the uttering, is not liable to cassation for omission of one of the elements of the offence on the ground that the date of the forgery itself is not stated. (1) IV.—One of the judges giving judgment in a civil action ordering the withdrawal of a false document, may sit subsequently in a penal action and decide whether or not the same document is a forgery punished by law, as in such a case the object of the two judgments is different. (1) The reason given for this decision is that the date given is sufficient to show that the prosecution for uttering the forgery was not prescribed and the court implies that the accused would not have benefited by the establishment of prescription as regards the charge of forgery. V. Contra Cass. 2 March 1901. O.B. III. No. 29 (and note) deciding that even where the judgment of conviction only extends to the uttering, the date of the forgery is none the less necessary. II.—Les nullités de procédure commises en première instance sont couvertes par le silence en appel ; le défaut donc de mention dans le procès-verbal de l'audience de première instance que cette audience a été publique ne constitue pas une nullité donnant lieu à cassation si le demandeur ne s'est pas prévalu de cette nullité en appel. (1) III.—Le jugement portant condamnation à une peine d'emprisonnement pour faux et usage de faux avec indication de la date de l'usage de faux, n'est pas susceptible de cassation pour défaut d'indication suffisante du fait qui motive la condamnation, à raison de l'omission de la date à laquelle le faux a été commis (1). IV.—Aucune disposition de la loi n'interdit au juge qui a collaboré à un jugement civil écartant une pièce produite comme fausse, de siéger ensuite dans une affaire pénale et d'apprécier si la confection de cette pièce constitue un faux tombant sous l'application de la loi, puisque les deux jugements diffèrent quant à leur objet. (1) La Cour de Cassation donne comme motif de cette décision, que la date mentionnée dans le jugement attaqué suffit pour démontrer que la poursuite pour usage de faux n'était pas prescrite et son arrêt implique que l'accusé n'avait aucun avantage à établir la prescription en ce qui concerne le faux. V. contra Cass. 2 Mars 1901 (O.B. III, N° 29, et note). Cet arrêt décide que, même lorsque le jugement de condamnation ne vise que l'usage de faux, la date du faux n'est pas moins nécessaire.
