وضع يد مشتر لعقار على هذا العقار مدة خمس سنوات لايزيل بطلان البيع الناتج من عدم أهلية البائع وانما يزيل البطلان الناتج عن عدم ملكية المملك (١) (١) يظهر أن هذا الحكم يقرر مبدأ آخر وهو بطلان العقد الصادر قبل العمل بدكريتو ١٩ نوفبر سنة ١٨٩٦ الخاص بالمجالس الحسبية من شخص فى الفترة التى بين قرار المجلس الحسبى القاضى بالحجر عليه وبين تأييد هذا القرار بحكم قاضى المحكمة الشرعية متى كان الشخص الصادر له العقد يعلم بحالة المحجور عليه الحقيقية
Summary (English)
COURT OF APPEAL 20 JANUARY 1903. MM. Saad Zaghloul Bey (Pres.); Halton, Perry (JJ.) SHEIKH ABD EL RAHMAN SALEM HUSSEIN v. ZENAB HANEM (C. C. Arts 128, 208, 70). Prescription—Sale—Nullity—Incapacity of Vendor—Acquisitive Prescription. The nullity of a contract of sale of an immovable resulting from the want of capacity of the vendor cannot be covered by possession during five years. Such possession only covers the nullity resulting from the fact that the vendor was not the true owner of the immovable sold. NOTE.—By this judgment the Court seems also to lay down the rule that, prior to the Decree of the 19th of November 1896, concerning the Meglis Hasby, a contract made by an individual during the interval between the decision of the Meglis Hasby interdicting him and the ratification of the decision by the Cadi of the Mehkemeh was void, if the other party to the contract was aware of the interdicted person's true situation.

COUR D'APPEL 20 Janvier 1903 MM. Saad Zaghloul Bey (Prés.); Halton, Perry (CC.). CHEIKH ABD EL RAHMAN SALEM HUSSEIN contre ZENAB HANEM ÈS-QUALITÉS (C. C. Arts 428, 208, 76). Prescription — Vente — Nullité — Incapacité du vendeur — Prescription acquisitive. La nullité de la vente d'un immeuble tirée de l'incapacité du vendeur, ne se couvre pas par la possession de l'acheteur pendant cinq ans, laquelle ne couvre que la nullité provenant de l'absence de droit de propriété chez le vendeur. NOTE. — Ce jugement semble consacrer, en outre, le principe que, avant le décret du 19 Novembre 1896, sur les Méglis Hasby, un contrat passé par un individu entre la décision du Méglis Hasby portant interdiction de cet individu et la confirmation de cette dernière par le Cadi du Mehkémeh, était nul si l'autre partie avait connaissance de la véritable situation de l'interdit.
