المبادئ المستخلصة
أولا — المحاكم الاهلية غير مختصة بالفصل فى صحة اعلام الحجر المطعون فيه بسبب عدم موافقة هيئة المجلس الذى أصدره ثانيا — لايترتب على عدم نشر اعلام حجر صادر من مجلس ملى قبطى أورثوذوكسى بطلان هذا الاعلام وعلى ذلك لايترتب على تركه نشره صحة عقد يبرمه المحجور عليه بعد صدور الحجر ثالثا — ليس من الضرورى لصحة اعلام حجر أن يكون هذا الاعلام صادرا فى مواجهة المحجور عليه ولا أن يعلن اليه بصفة خصوصية بل يكفى علم المحجور عليه به (٢) رابعا — اذا باع محجور عليه بعد توقيع الحجر فبيعه باطل دون حاجة الى النظر فى كون البيع فى مصلحته أو لا مالم يكن مع ذلك قاضى أحواله الشخصية قد أجاز البيع (٣) خامسا — قاضى الاحوال الشخصية هو وحده مختص بالفصل فى مسألة كون العقد الذى أبرمه المحجور عليه بعد الحجر هو فى مصلحته أو لا ويجب بناء على ذلك أن يرفض الطلب الذى يقدم امام المحكمة الاهلية باجراء تحقيق للنظر فى هذه المسألة (١) صدر حكم من محكمة الاستئناف بتاريخ ٢٣ دسمبر سنة ٩٠٢ بتأييد هذا الحكم من حيث مسألة اختصاص المحاكم الاهلية (يراجع نمرة ١) فقد أخذت محكمة الاستئناف بأسباب الحكم الابتدائى وزادت فيما يختص بنشر اعلام حجر واعلانه أنه لايترتب على تركهما الا حق للغير فى الرجوع على القيم الذى من واجباته هذه الاجراآت (٢) يراجع حكم محكمة الاستئناف الصادر فى ٢٩ مارس سنة ١٨٩٨ (القضاء سنة ٥ صحيفة ٣٠٦) (٣) يراجع حكم محكمة اسكندرية الصادر فى ١٨ فبراير سنة ١٨٩٧ (القضاء سنة ٤ صحيفة ٢٣٤)

The question of the validity of an Elam of interdiction disputed on the ground of a defect in the composition of the council which pronounced it, is not within the jurisdiction of the Native Tribunals. II. The publication of an Elam of interdiction pronounced by a religious council of the Orthodox Copts is not necessary on pain of nullity. The omission, therefore, of such publication does not render valid the contract made by the interdicted person after his interdiction. III. It is not necessary for the validity of an Elam of interdiction that it should be pronounced in the presence of the person interdicted nor that he should be served with a notice of the Elam in any special manner. It is sufficient that he should have knowledge of such Elam (2). IV. Where a sale has been concluded by an interdicted person subsequently to his interdiction the contract is null and void independently of the question whether the sale was or was not advantageous to his interests, unless it has been ratified by the judge of his personal law (3). V. The question whether or not a contract concluded by an interdicted person subsequently to his interdiction is advantageous to his interests belongs exclusively to the jurisdiction of the judge of his personal law. Consequently an investigation demanded before a Native Tribunal for the purpose of going into this question must be refused. (1) The judgment here summarised was upheld by the Court of Appeal by its judgment of 23 December 1902. For the question of jurisdiction of the Native Tribunals (v. Par. I) the Court of Appeal adopted the ground of the judgment of first instance and added with reference to the notification and publication of an Elam of interdiction that their omission can only give rise to an action on the part of third parties against the tutor whose duty it was to carry out these formalities. Les tribunaux indigènes sont incompétents pour statuer sur la validité des Elams d'interdiction contestée pour vice dans la composition du Conseil dont émane le dit Elam. II. La publication d'un Elam d'interdiction émané d'un Conseil religieux de Cophtes orthodoxes n'est pas requise à peine de nullité et, par conséquent, son omission ne rend pas valable un contrat fait par l'interdit après son interdiction. III. Il n'est pas nécessaire, pour sa validité, qu'un Elam d'interdiction soit rendu en présence de l'interdit ni qu'il lui soit notifié d'une façon spéciale. Il suffit que l'interdit en ait connaissance (²). IV. Lorsqu'une vente a été faite par un interdit après son interdiction, le contrat est nul, sans qu'il y ait lieu de distinguer si la vente lui a été ou non profitable, à moins toutefois, qu'elle n'ait été validée par le juge de son statut personnel (³). V. Le juge du statut personnel est seul compétent pour décider si un contrat fait par un interdit après son interdiction lui est ou non profitable. Par conséquent, doit être refusée l'enquête demandée au Tribunal indigène aux fins d'examiner cette question. (¹) Ce jugement a été confirmé par arrêt de la Cour d'Appel du 23 Décembre 1902. Pour la question de la compétence des Tribunaux indigènes, la Cour a adopté les motifs du jugement de première instance. Elle a ajouté, en ce qui concerne la publication et la notification d'un Elam d'interdiction, que leur omission ne fait que donner un recours aux tiers contre le tuteur à qui incombent ces formalités.
