المبادئ المستخلصة
لايقبل استئناف من يحكم عليه بتقديم حساب وبدفع غرامة عن كل يوم تأخر فى تقديمه اذا رفعه عن الجزء الاخير من هذا الحكم لانه لامصلحة فى هذا الاستئناف وذلك لانه من اختصاصات المحكمة الابتدائية أن تعفى من يحكم عليه بتلك الغرامة من دفعها اذا أثبت لها أن التأخر كان لسبب شرعى يراجع دالوز ١٨٦٥ جزء أول صحيفة ٢٢٦ نوتة ١ ودالوز فهرست (الشئ المحكوم فيه) ٣٨٤

COURT OF APPEAL 27 November 1902 MM. Ahmad Afifi Bey (Pres.); de Hults, Willmore (JJ.). MAHMOUD BEY ANIS v. BAILIFF OF THE TRIBUNAL OF ZAGAZIG AND OTHERS Rendering of accounts—Delay—Penalty—Appeal—Admissibility. If a person is ordered by the Court to render an account by a certain date and after that date to pay a specified sum of money per day until the account is rendered, his appeal against the latter part of the judgment will be rejected for lack of interest, since it lies within the power of the tribunal of first instance to exempt the losing party from the payment of the above-mentioned sums of money on his showing good and sufficient cause for delay. Lorsqu'une personne est condamnée à rendre compte et à payer une certaine somme par jour de retard apporté à la présentation du compte, l'appel interjeté contre cette dernière partie du jugement est irrecevable comme dépourvu d'intérêt; il en est ainsi parce qu'il appartient au tribunal de première instance d'exonérer la personne condamnée du paiement de ces sommes, si elle établit que les motifs du retard sont admissibles et légaux.
