العمدة الذى يأمر اناسا من أهل بلده بضرب انسان يقضى على نفسه بالمشاركة فى الجريمة الواقعة . ولا داعى للبحث فيما اذا كان فى استطاعة مرتكبيها مخالفة أمره أولا . فان ماله من السلطة عليهم بموجب وظيفته يكفى لمعاملته بمقتضى المادة ٦٨ من قانون العقوبات راجع حكم النقض الصادر بتاريخ ١٧ مايو سنة ١٩٠٢ (المجموعة الرسمية سنة رابعة صحيفة ٨٩)

Complicity—Abuse of authority—Omdeh. If an Omdeh orders one or more of the inhabitants of his village to commit an assault, he thereby becomes an accomplice in the offence and it is not necessary to enquire whether the principal offenders might or might not have refused to obey him. The authority he exercises over them by virtue of his office is sufficient to render him liable under Art. 68 of the Penal Code. V. Cass. 17 May 1902 (O.B. IV, No. 37, p. 34).

Arts 68, 219). Complicité — Abus d'autorité — Omdeh. Un omdeh qui ordonne à des individus de son village de donner des coups à un individu, se rend complice de l'infraction commise sans qu'il y ait lieu d'examiner si les auteurs auraient ou non pu lui désobéir. L'autorité qu'il exerce sur eux, en vertu de sa qualité, suffit pour lui rendre applicable l'art. 68 du Code Pénal. V. Cass. 17 Mai 1902 (O.B. IV, N° 37, p. 40).
