الصلح الواقع فى ملكية عقار مقابل دفع مبلغ من النقود لايمكن اعتباره بيعا يبنى عليه طلب الشفعة فان الصلح ليس فى الواقع عقدا ناقلا للملكية فاعتباره بمثابة عقد ناقل للملكية يترتب عليه الحكم بأن من دفع مبلغ النقود غير مالك وهو أمر لم يتعرض له فى الصلح ومع ذلك فان المبلغ المدفوع صلحا لايمثل قيمة العقار بل ماقد يكون للطرفين من الحظ فى كسب أو خسارة قضية بخصوص الملكية (١) (١) انظر الجزء الثالث فقرة ٩٩٧ من بودرى لا كنتينرى فيما للصلح من خاصة الاقرار على الملكية
Summary (English)
COURT OF APPEAL 25 April 1901 MM. Bond (Pres.); de Hults, Youssef Chawki, Bey (JJ.). MUHAMMAD BEY AHMAD v. AHMAD BEY ABOUL FETOUH (C. C. 69, 235). Compromise — Immovable property — Sale — Preemption. A compromise as to the ownership of immovable property in consideration of the payment of a sum of money, cannot be regarded as a sale on which a claim to preempt may be based. Such a compromise does not in fact constitute a transfer of ownership, and to recognise it as being capable of so doing would be to decide that the person who paid the sum of money was not the owner, whereas the latter question was not decided by the compromise. Again, the sum of money paid by way of compromise does not represent the true value of the immovable property in question, the said sum being in reality only the valuation by the parties of their respective chances of winning the action thus compromised. COUR D'APPEL 25 Avril 1901 MM. Bond (Prés.); de Hults, Youssef Chawki Bey (CC.). MOHAMED BEY AHMED contre AHMED BEY ABOUL FETOUH (C. C. 69, 235). Transaction — Immeuble — Vente — Préemption. Une transaction, moyennant le paiement d'une somme d'argent, sur la propriété d'un immeuble, ne peut pas être considérée comme une vente sur laquelle une demande de préemption peut être basée. En effet, une transaction ne constitue pas un acte translatif de propriété. Lui accorder ce caractère ce serait décider que celui qui a payé n'était pas propriétaire, question non tranchée par la transaction. D'ailleurs, la somme payée à titre de transaction ne représente pas la valeur de l'immeuble; elle n'est que l'évaluation des chances de part et d'autre dans un procès au sujet de la propriété. V.
