المبادئ المستخلصة
للدائن أن يحصل على حق اختصاص بعقارات مدينه بمقتضى محضر صلح تم بين طرفى الخصوم فى دعوى وصدّقت عليه المحكمة . ولا سيما اذا كانت المحكمة لم تقتصر على مجرد اثبات اتفاق الخصوم بل أعطت محضر الصلح شكل الحكم وألزمت المدين بالمصاريف . أشار الحكم الى ملحق موسوعات دللوز تحت كلمة «حقوق الامتياز والرهن» نبذة ٧٥٢ والبندكت الفرنسى تحت كلمة «حقوق الامتياز والرهن» نبذة ٦٧١٨ .

COURT OF APPEAL. 21 DECEMBER 1915. MM. Ahmad Ragheb Badr Bey (Pres.); Mustapha Fathy Bey, Hussein Darwish Bey (JJ.). YUSSEF GUBRAN v. KILADA MUBARAK. Judgment charge—Procès-verbal of compromise. (Art. 595 C.C. — Art. 68 C.C.C.Pr.) The procès-verbal of a compromise of an action, approved by the court, entitles the creditor to obtain a judgment charge on the immovable property of his debtor, especially where the court, in recording the agreement of the parties, gives to the procès-verbal the form of a judgment and orders the debtor to pay the costs. Cited in the judgment: DALLOZ. Supplément, V° Privilèges et Hypothèques, N° 752; PANDECTES FRANÇAISES, V° Privilèges et Hypothèques, N° 6718. The above judgment of the Court of Appeal is contrary to the opinion expressed by the Committee of Judicial Surveillance in its Circular No. 1 of 1914, of which the purport is as follows :— The provisions of Art. 595 C.C., relating to judgment charges, are exceptional provisions which must be construed restrictively. A judgment charge can only be obtained, therefore, in virtue of a judgment in the true sense. Moreover, the history of legislation concerning this matter shews that when the legislator suppressed judicial mortgages and substituted for them judgment charges, the intention was that such charges could only be obtained by creditors holding judgments. (See Decree of December 5, 1886). A compromise, entered into by the parties before the court and embodied in a procès-verbal, although constituting a judicial agreement binding on the parties cannot, however, be considered as a judgment; it is simply a contract. (See DALLOZ, Code Civil Annoté, Art. 2123, Nos. 31 and 32).

Droit d'affectation—Procès-verbal de transaction. (Art. 595 C.C. — Art. 68 C.P.C.C.) Le procès-verbal d'une transaction, faite dans une action et homologuée par le tribunal, autorise le créancier à obtenir un droit d'affectation sur les biens immeubles de son débiteur; et cela surtout lorsque le tribunal, en donnant acte de l'accord des parties, donne au procès-verbal la forme d'un jugement et condamne le débiteur aux frais. Cité dans l'arrêt: DALLOZ, Supplément au Répertoire, V° Privilèges et Hypothèques, n° 752; PANDECTES FRANÇAISES, V° Privilèges et Hypothèques, n° 6718. Cet arrêt de la Cour est contraire à l'avis émis par le Comité de Surveillance Judiciaire dans sa Circulaire n° 1 de 1914, dont nous donnons ici le résumé: L'art. 595 C.C., relatif au droit d'affectation hypothécaire, édicte des dispositions exceptionnelles qui doivent être interprétées restrictivement. Un droit d'affectation ne peut donc être obtenu qu'en vertu d'un jugement proprement dit. D'ailleurs, l'historique des travaux législatifs en la matière démontre que lorsque le législateur a voulu supprimer l'hypothèque judiciaire en la remplaçant par l'affectation hypothécaire, il n'a entendu autoriser l'affectation qu'en faveur des créanciers porteurs de jugements de condamnation (voir Décret du 5 décembre 1886). Une transaction intervenue entre deux parties devant le tribunal et constatée par un procès-verbal, bien que formant une convention judiciaire liant définitivement les parties, ne constitue cependant pas un jugement: elle ne constate qu'un contrat (voir DALLOZ, Code Civil Annoté, Art. 2123, n°s 31 et 32).
