المبادئ المستخلصة
ان الامر العالى الصادر بتاريخ ١٨ مايو سنة ١٨٩٢ الذى حصر فى بعض المحاكم اختصاص النظر فى الدعاوى التى تقام من الاهالى على الحكومة ليس قاصرا على حالة ما اذا كانت الحكومة مدعى عليها وحدها فى الدعوى بل ينطبق أيضا على حالة ما اذا كانت الحكومة مدعى عليها مع آخرين (١) (١) راجع الحكم الصادر من محكمة طنطا بتاريخ ٢٨ دسمبر ١٨٩٤ ( القضاء سنة ثانيه صحيفة ٩١ ) والقرار الصادر من لجنة المراقبة القضائية بتاريخ ٢٩ دسمبر ١٨٩٦ ( القضاء سنة رابعة صحيفة ٣ ) هذا المبدأ هو أكثر موافقة لقصد الشارع من وضع هذا الامر العالى من المبدا الذى قررته محكمة أسيوط الاهلية فى الحكم الصادر منها بتاريخ ٢٨ مايو ١٨٩٥ ( القضاء سنة ثانية صحيفة ٢٦٤ ) ومحكمة بنى سويف فى الحكم الصادر منها بتاريخ ٢٩ ابريل ١٨٩٤ ( القضاء سنة أولى صحيفة ١٥٣ ) فان تأويل هذا الامر العالى بالمعنى الذى أوله به الحكم المنشور أدناه ينطبق تماما على الفكرة التى قصدها الشارع من وضع هذا الامر كما يتضح ذلك من المذكرة التفسيرية التى رفعت الى مجلس النظار مع مشروع الامر العالى المذكور .

SUMMARY TRIBUNAL OF GHIZEH. 1 SEPTEMBER 1900. M. Ahmed Kamha Effendi (J.). IBRAHIM SAYED HEDAR v. ASSISTANT REGISTRAR OF THE SUMMARY TRIBUNAL OF GHIZEH AND ANOTHER. (Decree 18 May 1892). Jurisdiction—Action against the Government. The Decree of 18th May 1892 which provides that certain Courts alone shall be competent to try actions brought by natives against the Government, applies not only in a case where the Government is sole defendant but also where it is a co-defendant with others. (¹) (¹) This decision (see in the same sense, Trib. App. Tantah, 28 December 1894. El Cada II, 91; Cir. 29th December 1896. El Cada IV, 3) seems to be more in accordance with the intention of the legislator than the judgments of the Tribunals of Assiut dated 28th May 1895. (El Cada, II, 264) and of Beni Suef dated 29th April 1894. (El Cada I, 153). The interpretation given by the tribunal in the judgment published below is in conformity with the object which the legislature had in view, as is shewn by the note to the Council of Ministers accompanying the project of the decree (Official Documents 1892, p. 441).

TRIBUNAL DE JUSTICE SOMMAIRE DE GUIZEH 1er SEPTEMBRE 1900 M. Ahmed Camha Effendi (J.). IBRAHIM SAYED HÉDAR contre COMMIS GREFFIER DU TRIBUNAL DE JUSTICE SOMMAIRE DE GUIZEH ET CONSORTS (Déc. du 18 Mai 1892). Compétence — Procès contre le Gouvernement. Le décret du 18 Mai 1892, qui dispose que certains tribunaux connaîtront seuls des affaires qui sont intentées par les indigènes contre le Gouvernement, s'applique non seulement au cas où le Gouvernement est seul défendeur au procès, mais encore à celui où il est défendeur avec d'autres (¹). (¹) Cette décision (voir dans le même sens : Trib. App. Tantah 28 Déc. 1894 (El Cada II. 91) et Cir. 29 Déc. 1896. (El Cada IV. 3) semble s'accorder mieux avec l'esprit du législateur que les jugements des Tribunaux d'Assiout du 28 Mai 1895. (El Cada II. 254) et de Beni-Souef du 29 Avril 1894 (El Cada, I, 153). En effet, l'interprétation consacrée par le jugement reproduit ci-dessous est conforme au but que le législateur avait en vue, ainsi que cela résulte de la note an Conseil des Ministres accompagnant le projet de décret (Documents Officiels 1892 p. 441).
