لايجوز للمحاكم الجنائية ان تحكم فى التهم المطروحة لها بمجرد الاطلاع على أوراق الدعوى من غير سماع شهود فى الجلسة والا كان حكمها باطلا يجوز نقضه
Summary (English)
COURT OF CASSATION 29 DECEMBER 1900 MM. Saleh Sabet Pasha (Pres.); de Hults, Cassem Amin Bey, Coghlan, Youssef Chawki Bey, (JJ.); Muhammad Safwat Bey (State Rep.). ABDEL RAZEK KHALIL v. STATE REPRESENTATIVE (C. Cr. Pr. Art. 220 and follg.—Arts 131-160-200). Cassation—Substantial ground of nullity—Hearing witnesses. It is not permissible for a Criminal Court to decide upon the merits of a charge after merely reading the documents in the case, without hearing witnesses at the trial. The fact that witnesses were not heard in Court constitutes a substantial nullity affording a ground for Cassation.

ABDEL RAZEK KHALIL contre MINISTÈRE PUBLIC (C. I. C. Art. 220 et ss. — Arts. 131-160-200.) Cassation — Nullité substantielle — Audition de témoins. Les Tribunaux répressifs ne peuvent statuer au fond sur le vu des pièces sans audition de témoins à l'audience. L'omission d'entendre des témoins constitue une nullité substantielle donnant ouverture à cassation.
