المبادئ المستخلصة

(١) — تكون جريمة الرشوة تامة متى قبل الموظف الهدية التى عرضت عليه وتكون هذه الجريمة شروعا فيها اذا عرضت عليه فلم يقبلها . يحصل الشروع فى الرشوة بمجرد وعد الراشى باعطاء الهدية ولو لم يبرزها فعلا أو لم يعين نوعها ولا قيمتها ان الشروع فى الرشوة يجوز أن يحصل بواسطة شخص ثالث ( المادة ٩٢ من قانون العقوبات ) ٢ — اذا رفع القاضى الذى عرضت عليه الرشوة فلم يقبلها شكواه الى رئيس محكمته فأحالها هذا على النيابة العمومية ثم رأس الرئيس الموما اليه الجلسة التى حكمت على المتهم بالعقوبة فالحكم فى هذه الحالة صحيح لا يجوز نقضه لان الرئيس لم يبد رأيا مما فى القضية قبل الحكم حتى كان يسوغ رده (١) ٣ — لايلزم ان يشتمل نص الحكم على بيان الواقعة بل يكفى ان يكون هذا البيان مذكورا ضمن اسبابه [حاشية] (١) حكمت محكمة النقض والابرام بأن القواعد المتعلقة برد القضاة فى المسائل المدنية يجب تطبيقها فيما يختص بردهم فى القضايا الجنائية ( راجع حكم محكمة النقض والابرام الصادر بتاريخ ١٦ نوفمبر ١٨٩٥ ( القضاء سنة ثالثة صحيفة ٦٢ ) وعلى ذلك فيجوز رد القاضى اولا — اذا حكم فى القضية فى محكمة اول درجة وجلس للحكم فيها فى محكمة ثانى درجة ( راجع الاحكام الصادرة من محكمة النقض والابرام بتواريخ ٢٥ مايو ١٨٩٥ ( القضاء سنة ثانيه صحيفة ٢٧٦ ) و ١٦ نوفمبر ١٨٩٥ ( القضاء سنة ثالثة صحيفة ٦٢ ) و ١١ ديسمبر ١٨٩٧ ( القضاء سنة خامسة صحيفة ٦٦ ) ثانيا — اذا كان القاضى أمر بالقبض على متهم بشهادة زور وجلس للحكم فى قضيته ( راجع حكم محكمة النقض والابرام الصادر بتاريخ ٣١ ديسمبر ١٨٩٨ ( القضاء سنة سادسة صحيفة ٨٤ ) ثالثا — وعلى وجه العموم كل قاض أجرى تحقيقا مايكشف من رأيه فى القضية ( راجع حكم محكمة النقض والابرام الصادر بتاريخ ٣١ ديسمبر ١٨٩٨ القضاء سنة سادسة صحيفة ٨٤ وقرار لجنة المراقبة الرقيم ٢١ مايو سنة ١٨٩٥ ( القضاء سنه ثانيه صحيفة ١٩٤ ) أما ما يتعلق بمعرفة ما اذا كان القاضى يجب عليه أن يمتنع من الحكم من تلقاء نفسه والا كان حكمه لاغيا فان محكمة النقض والابرام أصدرت فى هذا الموضوع حكمين أحدهما بالايجاب والآخر بالسلب ( راجع هذين الحكمين الصادرين بتاريخى ٢٥ مايو ١٨٩٥ و ١٦ نوفمبر ١٨٩٥ المشار اليهما قبلا

Summary (English)

COURT OF CASSATION 27 April 1901. MM. Cassem Amin Bey (Pres.); de Hults, Youssef Chawki Bey, Coghlan, Ahmad Zeiwar Bey (JJ.); Muhammad Safwat Bey (State Rep.). MIKHAIL MAKAR v. STATE REPRESENTATIVE (I. P.C. Arts 89 follg.—II. C. Cr. Pr. Arts 155, 220 follg.—C.C.C. Pr. Art. 309.—III. C. Cr. Pr. Arts 220 follg.). I. Bribery—Attempted offence—Offer not specified—Intermediary. II. Composition of Court — Recusation — Impartiality. III. Operative part of judgment—Designation of offence. I. The crime of bribing a public official (Arts 89 follg. P.C.) is to be deemed completed when the gratification offered has been accepted by the official, and attempted when the offer has not been accepted. The making of an offer to "give a gratification" constitutes an attempt to bribe, even though the gratification has not been exhibited, nor its value or nature determined. An attempt to bribe may be committed by the instrumentality of a third person (Cf. Art. 92 P.C.) II. A judgment given by a Court irregularly composed is liable to Cassation. The fact however that the President of a Tribunal had forwarded to the Parquet a charge of attempted bribery, sent to him by one of the magistrates of his Tribunal whom it had been attempted to bribe, does not of itself render it improper for such President to preside at the hearing at which sentence for the attempted bribery is passed; for, having expressed no opinion on the case, there are no grounds for recusing him (1). III. It is not necessary that the designation of the offence punished should appear in the operative part of the judgment; it is sufficient if such designation is contained in the motives. (1) As regards the recusation of a judge in a criminal cause the courts have decided that the same rules must be applied as in civil proceedings (Cass. 16 November 1895, El Cada III, 62). Thus a judge has been held liable to recusation in the following cases; 1. If he sits to hear a case on appeal, after having tried the matter in first instance (Cass. 25 May 1895, El Cada, II, 276; 16 November 1895, El Cada III, 62; 11 December 1897, El Cada V, 66). 2. If he sits to hear a charge of giving false evidence, brought against a person whom he caused to be arrested for such offence at the hearing of a previous case (Cass. 31 December 1898, El Cada VI, 84). 3. Speaking generally, if he has taken any such step in the preliminary examination as allows his opinion on the case to appear (Cass. 31 December 1898, El Cada VI, 84; Cir. 21 May 1895, El Cada II, 194). As regards the question whether or not in these cases the judge ought under pain of nullity to recuse himself of his own motion, the judgment of the Court of Cassation of 25 May 1895 above quoted has decided the affirmative; see however contra Cass. 16 November 1895 (also quoted above).

Arts 89 ss.— II — C.I.C. Arts 155, 220 ss. C.P.C.C. Art. 309.— III — C.I.C. Arts 220 ss.). I. Corruption — Tentative — Offres non déterminées — Intermédiaire. II. Composition du Tribunal—Récusation—Impartialité. III. Dispositif — Désignation de l'infraction. I. Il y a, de la part du corrupteur, crime de corruption consommé quand le présent offert a été accepté par le fonctionnaire public, et tentative de corruption quand le présent n'a pas été accepté. La tentative existe lorsque l'offre consiste dans la promesse de "donner un présent", bien que celui-ci n'ait pas été exhibé, ni même déterminé, quant à sa nature ou sa valeur. La corruption peut être tentée par l'intermédiaire d'une tierce personne (C.P. art. 92). II. Ne doit pas être cassé, comme étant rendu par un Tribunal irrégulièrement composé, un jugement de condamnation pour tentative de corruption, rendu sous la présidence du Président du Tribunal qui n'a fait que transmettre au parquet une plainte qui lui avait été envoyée par le magistrat de son Tribunal, à l'égard duquel cette tentative avait eu lieu; le Président, n'ayant dans ce cas émis aucun avis, ne devait pas se récuser (1). III. Un jugement ne doit pas renfermer dans son dispositif la désignation de l'infraction; il suffit que cette désignation se trouve dans les motifs. (1) En ce qui concerne la récusation en matière pénale, la jurisprudence a décidé qu'il y a lieu d'appliquer les mêmes règles qu'en matière civile. (Cass. 16 Novembre 1895, El Cada III, 62.) Ainsi sont récusables : 1° Un juge qui siège en appel après avoir connu de l'affaire en première instance. (Cass. 25 Mai 1895, El Cada II, 276; 16 Novembre 1895, El Cada III, 62; 11 Décembre 1897, El Cada V, 66). 2° Un juge appelé à juger un individu qu'il a fait arrêter pour faux témoignage à une audience précédente (Cass. 31 Décembre 1898. El Cada VI, 84). 3° D'une façon générale le juge qui a fait tout acte d'instruction qui laisse entrevoir son avis dans l'affaire (Cass. 31 Décembre 1898, El Cada VI, 84; Cir. 21 Mai 1895, El Cada II, 194). Quant à la question de savoir si dans ces cas le juge doit ou non se récuser d'office sous peine de nullité, voir dans le sens de l'affirmative l'arrêt de la Cour de Cassation du 25 Mai 1895, et dans le sens contraire, l'arrêt de la même Cour du 16 Novembre 1895, cités ci-dessus.
