المبادئ المستخلصة
١ — اذا رفعت جنحة الى قاضى الامور الجزئية فحكم بعدم اختصاصه لما تراءى له من القرائن ان الفعل جناية لاجنحة فان حكمه فى هذه الحالة ليس حكما متعلقا بالتحقيق وانما هو حكم بعدم الاختصاص أخرج القضية عن سلطته فيجوز استئنافه ٢ — اذا ألغت محكمة ثانى درجة حكم المحكمة الجزئية الصادر بعدم الاختصاص فى جنحة (المادة ١٧٣ من قانون تحقيق الجنايات) فان القاضى الموما اليه يجب عليه أن يحترم حكم الاستئناف ويعمل به متى رفعت اليه القضية مرة ثانية فاذا أصر على رأيه الاول وحكم ثانية بعدم اختصاصه ورفع استئناف عن هذا الحكم فان محكمة الاستئناف يجب عليها ان تقبل الاستئناف من حيث شكله وتحكم فى موضوع الدعوى (١) فمن ثم اذا رفضت محكمة ثانى درجة استئنافا رفع فى مثل هذه الظروف فيجوز نقض حكمها فى هذه الحالة (١) راجع حكم محكمة النقض والابرام الصادر فى ٥ نوفبر سنة ١٨٩٨ (القضاء سنة سادسة صحيفة ٤)

ROUMAN SALEH IBRAHIM AND OTHERS (I. C. Cr. Pr. Arts. 173, 174.—II. C. Cr. Pr. Arts. 173, 174, 220). I. Correctional Tribunal—Primà facie case of Crime—Declaration of want of jurisdiction—Appeal. II. Cassation—Substantial ground of nullity—Correctional Tribunal—Primà facie case of crime—Declaration of want of jurisdiction—Appeal—Second declaration of want of jurisdiction—Second appeal—Evocation. I. The decision by which a summary judge, before whom a charge of misdemeanour is brought, declares that he has not jurisdiction to try the case, since in his opinion the facts show a primà facie case of crime (Art. 173 C. Cr. Pr.), is not to be regarded as a mere measure of preliminary examination, but as a judgment declining jurisdiction. An appeal will therefore lie against such decision. II. When a judgment, by which a summary judge has declined jurisdiction, since the case is primà facie one of crime (Art. 173 C. Cr. Pr.), is reversed on appeal, the summary judge before whom the case is brought afresh is bound by the decision given on appeal. If he declines jurisdiction a second time, and this last decision is appealed against, the Court before which the appeal is brought must allow that the appeal will lie and determine the case on its merits by evocation (¹). If therefore such Court decides that no appeal will lie in the circumstances mentioned, this decision is subject to Cassation, as vitiated by a substantial nullity. (¹) Cf. La décision par laquelle un juge sommaire, saisi d'une poursuite pour délit, se déclare incompétent parce qu'il estime qu'il y a présomption de crime (art. 173 C. I. C.), ne constituant pas une mesure d'instruction mais un jugement d'incompétence, est susceptible d'appel. II. Lorsque le Tribunal d'appel infirme un jugement du Juge Sommaire, par lequel ce dernier s'est déclaré incompétent à raison d'une présomption de crime (art. 173 C.I.C.), le Juge Sommaire devant lequel l'affaire est portée de nouveau se trouve lié par la décision d'appel. Si le Juge Sommaire se déclare une seconde fois incompétent et qu'appel est interjeté contre cette dernière décision, le Tribunal d'appel doit recevoir l'appel et statuer au fond par évocation (¹). Est dès lors susceptible de cassation, pour nullité substantielle de la sentence, la décision du Tribunal d'appel qui dans de telles circonstances décide que l'appel n'est pas recevable. (¹) Cp.
