COURT OF CASSATION 7 April 1900 MM. Saleh Sabet Pasha (Pres); de Hults, Saad Zaghloul Bey, Youssef Shawki Bey, Halton (JJ.); Muhammad Safwat Bey (State Rep.). MUHAMMAD SHAMSEDDINE v. STATE REPRESENTATIVE (C. Cr. Pr. Arts. 135, 160, 205, 220). Cassation—Substantial ground of nullity—Accused person's right of final reply. The fact that the accused person was not heard last (C. Cr. Pr. Arts. 135, 160, 205) does not constitute a substantial nullity affording a ground for Cassation, in a case where it is shewn that the State Representative had not in any way modified his original conclusions, and that the accused did not claim the right of final reply.(¹) (¹) Cf. MOHAMED CHAMSEDDINE contre MINISTÈRE PUBLIC (C. I. C. arts 135, 160, 205, 220) Cassation — Nullité substantielle — Défaut d'entendre le prévenu le dernier. Le fait de ne pas avoir entendu le prévenu le dernier (C. I. C. arts 135, 160, 205) ne constitue pas une nullité substantielle, donnant ouverture à Cassation, dans le cas où il est établi que le Ministère Public n'a modifié en rien ses premières conclusions et que le prévenu n'a pas demandé la parole le dernier(¹).
