طلب تعيين حارس قضائى اذا كانت هنالك دعوى أصلية يجب ان يرفع الى المحكمة المرفوعــة أمامها الدعوى الاصــلية (١) متى كانت الاصــول الجارى عليها العمل أمام تلك المحكمة تجــيز تعيين الحارس القضائى أما اذا لم يكن هنالك دعوى أصلية فيقدم الطلب الى المحكمة الجزئيــة عــملا بالمادة ٢٨ مــن قانون المرافعــات (٢) (١) راجــع الحكــم الصــادر من محكمــة طنطا الاستئنافية بتاريخ ٩ اكتوبر سنة ١٨٩٣ (القضا سنة اولى صحيفة ٨٧) (٢) لم يأخذ هــذا المنشور بالمبــدا الذى قررته محكمة مصر فى الحكم الصادر منها بتاريخ ٢٣ اكتوبر ١٨٩٤ المندرج بالسنة الثانيــة من مجــلة القضا صحيفة ١٨٥ منها ومقتضاه أن المحكمة الابتدائية مختصة فى جميــع الاحوال بالنظر والحكم فى طلب تعيين الحارس القضائى ولو لم تكن منظورة أمامها دعوى أصليه وان اختصاص القاضى الجزئى بالنظر فى مثل هــذه الطلبات اختصاص استثنائى لايكون الا فى حالة الاستعجال ولاغنى من الرجوع الى المحكمة الابتدائية
Summary (English)
Circular of the Committee of Judicial Surveillance. 26 April 1901, No. 6. ( C.C.C.Pr. Art. 28—C.C. Art. 491). Judicial Receiver — Appointment — Jurisdiction. An application for the appointment of a judicial receiver, made in the course of an action already commenced, must be brought before the Court which is trying such action, (¹) provided always that the law administered by such Court admits of the appointment of a judicial receiver. When however the appointment of a receiver is claimed by an original application, not made in a cause already pending, such application must be brought before the Summary Tribunal in accordance with Art. 28 C.C.C. Pr. (²) (¹) Cf. Trib. App. Tantah 9 October 1893 (El Cada I, 87). (²) It will be seen that the Committee of Surveillance in this Circular has not adopted the theory enunciated in a judgment of the Tribunal of Cairo, dated 23 October 1894 (El Cada, II, 185). According to this latter theory, the Tribunal of First Instance has a general jurisdiction to appoint a judicial receiver in all cases, even though the substantial action in which such appointment is claimed is not pending before it, the Summary Tribunal having, however, in urgent cases, an exceptional jurisdiction, concurrent with that of the Tribunal of First Instance.

Circulaire du Comité de Surveillance Judiciaire 26 Avril 1901 N°. 6. (C. P. C. C. Art. 28 — C. C. Art. 491). Séquestre judiciaire — Nomination — Compétence. Si la demande en nomination de séquestre judiciaire a lieu au cours d'une instance déjà engagée, elle doit être portée devant le Tribunal saisi de l'instance principale (¹), pourvu que la législation qu'applique ce Tribunal admette la théorie du séquestre judiciaire. Toutefois, si la demande a lieu en dehors d'un procès déjà pendant, elle doit être portée devant le Tribunal Sommaire par application de l'Art. 28 du C.P.C.C. (²). (¹) Cp. Trib. App. Tantah, 9 Octobre 1893 (El Cada, I. 87). (²) La circulaire s'écarte de la théorie du jugement du Tribunal du Caire du 23 Octobre 1894 (El Cada II. P. 185) d'après laquelle le Tribunal de première instance aurait une compétence générale pour nommer un séquestre judiciaire dans tous les cas, alors même qu'il ne serait pas saisi de la contestation du fond, le Juge sommaire ayant cependant en cas d'urgence une compétence exceptionnelle concurrente avec celle du dit Tribunal.
