المبادئ المستخلصة

COURT OF APPEAL 12 DECEMBER 1899 MM. Kassem Amin Bey (Pres.); Willmore, Youssef Chauki Bey (JJ.). MUHAMMAD ABDEL GAWAD RAHOUMA v. SHEIKH MUHAMMAD EL BAYOUMI (C. C. Art. 73) I. Preemption—Offer of the price. II. Preemption—Conditions of exercise—Vicinity. I. In cases of preemption, there is no provision of the law obliging the preemptor to pay the price that he offers, in order to avail himself of his right of preemption. It is sufficient if he has declared that he is ready to pay the price, and the costs properly incurred. (1) II. If the preemptor is within the conditions laid down by law in the case of preemption, his action cannot be dismissed on the ground that the right of preemption was instituted in order to enable landowners to escape the inconvenience arising from the proximity of undesirable neighbours, and that in fact no such inconvenience is shewn to exist. II. Préemption—Conditions d'exercice—Voisinage. I. En matière de préemption il n'existe aucune disposition qui oblige le préempteur, pour se prévaloir de son droit de préemption, de payer le prix qu'il offre. Il suffit qu'il ait déclaré qu'il est prêt à payer ce prix et les loyaux coûts (1). II. Si le préempteur est dans les conditions prescrites par la loi pour préempter, son action ne saurait être repoussée par le motif que le droit de préemption a été créé en vue de permettre aux propriétaires fonciers d'écarter l'inconvénient qui naîtrait du fait d'avoir des voisins peu désirables, alors que dans l'espèce semblable inconvénient fait défaut (2).
