المبادئ المستخلصة
١ الاحكام القطعية الصادرة من هيئة لها ولاية الفصل فى الخصومات اذا لم تكن قابلة للطعن فيها بطريق من الطرق المقررة لذلك تكون حائزة لقوة الشئ المحكوم فيه نهائيا ويعتبر ما قضى به حقيقة مقررة بين الخصوم فلايجوز الرجوع فى شئ مما تقرر فيها مهما كانت أوجه البطلان اللاحقة بهذه الاحكام فبناء على ذلك تكون المحكمة مقيدة بالحكم الصادر بقبول الالتماس فلا يمكنها ان تعيد النظر الا فى الاوجه التى قبل التماس اعادة النظر فيها ٢ اذا كان الالتماس خاصا ببعض الاوجه المحكوم فيها فلا تعيد المحكمة النظر الا فى الامور التى تعلق الطعن بها وكذلك اذا كان الطعن عاما ولكنه مبنى على سبب خاص ببعض الاوجه المحكوم بها أو على أسباب لم يقبل منها الا ما كان خاصا هذا اذا لم يكن بينها ارتباط جوهرى يتعذر معه فصل بعضها عن بعض (١) (١) راجع الحكم الاستئنافى الرقيم ٤ مايو سنة ١٨٩٩ المدرج فى مجلة القضاء سنة ٦ صحيفة ٣٠٨

COURT OF APPEAL 22 FEBRUARY 1900 MM. Saad Zagloul Bey, (Pres.); de Hults, Coghlan, (J.J.) MOHAMMMAD RATIB PASHA v. FATMA DAWLAT HANEM (I — C.C.C.Pr. 372 Arts. follg.—II — C.C.C. Pr. Art. 376.) I — Application for retractation of judgment (Requête civile)—Res judicata—Judgment admitting application (Rescindant)—Judgment on merits (Rescisoire).—II — Application for retractation of judgment (Requête civile)—Grounds of objection—Heads of judgment affected—Connection. I—When a judgment upon the merits, given by a competent Court, is not open to any form of review, it acquires by that circumstance the force of res judicata. When such is the case, the questions thereby decided cannot be reopened whatever grounds of invalidity may be alleged against the judgment. Consequently in the case of an application for retractation of judgment (Requête civile) the Court which has to decide upon the merits of the application (Tribunal du Rescisoire), is bound by the judgment of the Court which decided the primâ facie admissibily of the application (Tribunal du Rescindant,) and cannot consider questions, which do not fall within the limits prescribed by the latter Court. II—When an application for retractation of judgment (Requête civile) is directed against certain heads of a judgment alone, these heads alone can be reversed. Similarly, when such an application, although directed against the judgment as a whole, is based upon objections which apply only to certain heads thereof, or when only some of the applicant's objections are admitted as relevant, and these objections apply to certain heads alone, the Court cannot reverse the judgment as regards other heads than those affected by the grounds of objection admitted (1). The only exception to these rules is when there exists between these heads and the other heads of the judgment a connection so close as to let in the possibility, in the event of their separation, of a contradiction between the two judgments. I — Quand un jugement sur le fond, rendu par un Tribunal ayant droit de juridiction, n'est susceptible d'aucune voie de recours, il acquiert par là l'autorité de la chose jugée. On ne peut plus alors revenir sur les questions qui y ont été décidées, quelles que soient les causes de nullité qu'on puisse attribuer à ce jugement. En conséquence le Tribunal du rescisoire est lié par le jugement du Tribunal du rescindant, et ne peut sortir des limites tracées par ce dernier. II — Lorsqu'une requête civile n'est dirigée que contre certains chefs seulement d'un jugement, le Tribunal ne retractera le jugement qu'en ce qui concerne les chefs attaqués. De même lorsqu'une requête civile est dirigée contre le jugement entier, mais basée sur des moyens qui ne concernent que des chefs déterminés, ou sur des moyens dont le Tribunal n'en accepte que quelques-uns relatifs à certains chefs, les chefs atteints par les moyens admis seront seuls rétractés (1). Ces règles toutefois souffrent exception lorsqu'il existe entre ces chefs et les autres un lien de connexité de nature à rendre impossible leur séparation, sans donner lieu à la possibilité d'une contradiction entre les deux jugements.
