المبادئ المستخلصة
لا يجوز لمن اشترى عينا للغير حق عينى عليها غير مسجل أن يتمسك بتسجيله عقب شرائه اضرارا بصاحب الحق العينى اذا كان شراؤه مع سوء القصد والتواطؤ مع البائع جاء فى احدى حيثيات هذا الحكم ان علم المشترى بوجود الحق العينى ولو كان غير مسجل مانع له من التمسك بعدم تسجيل هذا الحق على انه من الممكن ان يكون المشترى غير سىء النية مع علمه بوجود الحق العينى ومثل هذه الحالة وان كانت نادرة الوقوع الا انها جائزة (راجع دلوز فى التسجيل فى المتن) وقد جرت المحاكم الفرنسوية فى مثل هذه الحالة على ان مجرد العلم غير كاف وحده فى حرمان المشترى من الاولوية التى له بمقتضى تسجيل عقد شرائه على صاحب الحق العينى الذى لم يسجل عقده راجع دلوز ( فى تسجيل الرهن العقارى ) نمرة ٤٩١ وما يليها و ( فى الحقوق بين الاحياء الآيلة من عقود انتقال الملكية والحقوق الآيلة بمقتضى عقود وصية ) نمرة ١٥٧٠ وما يليها و ( فى الرهن العقارى ) نمرة ٩٥٧

TRIBUNAL OF CAIRO JUDGMENT ON APPEAL, 21 January 1899 MM. Ahmad Fathi Bey (Pres.); Amin Ali Effendi, Ahmad Talaat (J.J.). ABOUZED MOUSSA v. MUSTAHPA MUSTAPHA (C. C. Art. 611). Transcription—Real right not transcribed—Subsequent sale transcribed—Bad faith—Effect. A purchaser of immovable property, encumbered with a prior real right which has not been transcribed, who has acted in bad faith and in connivance with the fraud of his vendor, but has effected transcription of his contract, cannot rely on such transcription in order to obtain priority over the person in whose favour the real right was previously constituted, in spite of the omission of the latter to observe the formalities of transcription (1). (1) In one of the motives of the judgment above summarised the Court lays down, that the mere fact that the purchaser had notice of the existence, prior to the transcription of his contract, of an instrument not transcribed purporting to create a real right, is sufficient to debar such purchaser from relying on the non-transcription of such prior instrument. The case where a purchaser has such notice, without at the same time conniving at a fraud on his vendor's part, though rarely occurring would seem nevertheless to be possible (Dalloz Suppl. "Transcription hypothécaire" No. 177). It is to be noted that the French Courts, when dealing with these exceptional cases, appear to favour the view that notice of the prior contract does not of itself deprive the purchaser of the priority which he would otherwise acquire by transcription. TRIBUNAL DU CAIRE JUGEMENT D'APPEL DU 21 JANVIER 1899 MM. Ahmed Fathi Bey (Prés.); Amin Ali Effendi, Ahmed Talaat (J.J.). ABOUZED MOUSSA contre MOUSTAFA MOUSTAFA (C. C. Art. 611). Transcription — Droit réel non transcrit — Vente ultérieure transcrite — Mauvaise foi — Effets. En cas d'aliénation d'un immeuble grevé d'un droit réel non transcrit, l'acquéreur qui, ayant acquis de mauvaise foi et à la suite d'un concert frauduleux avec le vendeur, a fait transcrire son titre, ne peut se prévaloir de cette transcription au détriment du bénéficiaire du droit réel antérieur, qui a omis de remplir cette même formalité (1). (1) Dans un des attendus du jugement résumé ci-dessus, le Tribunal déclare que la simple connaissance par l'acheteur de l'existence d'un acte constitutif d'un droit réel non transcrit, antérieur à la transcription de l'acte de vente, empêche l'acheteur de se prévaloir de ce défaut de transcription. Le cas où il y a cette connaissance, sans qu'il y ait en même temps fraude de la part de l'acheteur, bien que se présentant rarement, est cependant, semble-t-il, possible. (V. Il est à noter que la Jurisprudence française paraît consacrer le principe, que, dans ces cas exceptionnels, la simple connaissance n'est pas suffisante pour priver l'acquéreur de la priorité résultant de la transcription de son acte.
