COURT OF APPEAL 12 December 1899 MM. Cassem Amin Bey (Pres.); Wilmore, Youssef Chauki Bey (J.J.) GABR. GHIRGHIS MAHFOUZ AND OTHERS v. BOUTROS EFFENDI MAHFOUZ Personal law — Succession — Non-Muhammadan natives—Law applicable—Agreement of parties interested. Muhammadan law is not applicable to questions of succession between non-Muhammadan natives, except in the case of a failure on the part of one or more of the parties interested to agree to the application of their personal law (1). In order to decide what law is to be applied, the Court must inquire whether the parties were so agreed or not at the time of the death of the testator or intestate. (1) Cp. GHIRGHIS MAHFOUZ ET CONSORTS contre BOUTROS EFFENDI MAHFOUZ Statut personnel — Successions — Indigènes non musulmans—Loi applicable—Accord des ayants droit. En matière de succession entre indigènes non musulmans, la loi musulmane n'est applicable que si tous les ayants-droit ne sont pas d'accord pour être régis par la loi de leur statut personnel (1). Le tribunal, pour déterminer quelle loi est applicable, doit examiner si l'accord entre les intéressés existait ou non au moment de la mort du de cujus.
