مهندس ديوان الاوقاف ليس من الموظفين المكلفين بخدمة عمومية بالمعنى المقصود من المادة ١١٧ من قانون العقوبات فلا يعاقب بمقتضى هـذه المادة من تعدى عليه أثناء تأدية وظيفته

MARKAZ TRIBUNAL OF IMBABAH 8 APRIL 1903. MM. Abd-el-Aziz Muhammad Effendi (J.); Abd-el-Hamid Hassan Effendi (State Rep.). STATE REPRESENTATIVE v. MUHAMMAD HAMMOUDAH MUHAMMAD Indignity offered to public servant—Engineer of Wakf Administration. (P.C. art. 117.) I.—An engineer of the Wakf Administration is not a person entrusted with a public duty within the meaning of art. 117 P.C. An indignity offered to him in the performance of his duties is, therefore, not punishable under that article.

MINISTÈRE PUBLIC contre MOHAMED HAMMOUDAH MOHAMED Outrage contre un fonctionnaire — Ingénieur de l'Administration des Wakfs. (C.P. art. 117). Un ingénieur de l'Administration des Wakfs n'est pas une personne chargée d'un service public dans le sens de l'art. 117 C.P. Il s'ensuit qu'un outrage commis contre lui dans l'exercice de ses fonctions, ne tombe pas sous le coup du dit article.
