الحكم الغيابى الصادر بعقوبة فى جنحة يجب اعلانه لشخص المحكوم عليه فى ميعاد ثلاث سنوات من تاريخه فاذا لم يعلن المتهم شخصيا فى هذه المدة يعتبر الحكم كأنه آخر عمل متعلق بالتحقيق وبناء على ذلك يسقط الحق فى اقامة الدعوى العمومية طبقا للمادة ٢٧٩ من قانون تحقيق الجنايات راجع حكم محكمة طنطا الاستئنافى الرقيم أول مارس سنة ١٩٠٨ (المجموعة الرسمية سنة ٩ عدد ٥٥)

STATE REPRESENTATIVE v. MIKHALY SLAMONIDIS Public action—Prescription—Judgment by default—Personal service. (C.Cr.Pr. art. 279.) A judgment convicting of misdemeanour in default of appearance must be served on the accused in person within three years of its date. When personal service has not been effected within that period, the judgment is to be deemed merely the last proceeding in the investigation and the public action is, therefore, barred under art. 279 C.Cr.Pr. Cf. Trib. App. Tanta, 1st March 1908 (O.B. IX. No. 55.)

MINISTÈRE PUBLIC contre MIKHALI SLAMONIDIS Action publique — Prescription — Jugement par défaut — Signification à personne. (C.I.C. art. 279). Dans le cas d'un jugement par défaut portant condamnation pour délit, la signification à personne est requise dans les trois années à partir de la date du jugement. Lorsque la signification à personne n'a pas été faite dans ce délai, le jugement n'est considéré que comme le dernier acte de l'instruction et l'action publique se trouve par conséquent prescrite en vertu de l'art. 279 C.I.C.
