سمو الجناب العالى الخديوى هو أمير البلاد وحاكمها الاعلى فلا يجوز أن ترفع عليه دعوى شفهيا أمام محاكم بلاده بطلب تعويضات والدعاوى الناشئة عن تعهدات شخصية لجنابه العالى انما ترفع ضد ناظر الدائرة الخاصة دون غيره راجع حكم محكمة الاستئناف المختلطة الرقيم ١٣ مايو سنة ١٩٠٣ (مجلة التشريع والاحكام المختلطة سنة ١٥ صحيفة ٢٨١)

TRIBUNAL OF ALEXANDRIA 19 DECEMBER 1908. MM. Muhammad Saleh Bey (Pres.); Percival, Abd-el-Maguid Farid Bey (JJ.). ALY RAHMY BEY v. H. H. THE KHEDIVE Jurisdiction—H. H. the Khedive—Representation by the "Daïra Khassa." (C.C.C.Pr. art. 8, 3°). His Highness the Khedive is the sovereign ruler of the country and cannot, therefore, be personally sued for damages in his own Courts. Personal claims against him can be enforced only by an action brought against the Director of the Daïra Khassa. Cf. App. Mixed, 13 May 1903 (B.L.J. XV, 281.)

A. le Khédive — Représentation par la " Daïra Khassa." (C.P.C.C. art. 8, 3°) Son Altesse le Khédive est le chef souverain du pays; on ne saurait, par conséquent, prétendre pouvoir le poursuivre devant ses propres tribunaux en vue d'obtenir des dommages-intérêts. C'est contre le Directeur de la Daïra Khassa, seulement, que l'on peut poursuivre le recouvrement d'une obligation personnelle de Son Altesse. Cf. App. Mixte, 13 mai 1903, (B.L.J. XV, 281).
