ماجاء بنص بعض اللوائح الخصوصية من أن من يخالف هذه اللوائح يعاقب بالعقوبات المقررة للمخالفات لايقصد به سوى الاحالة على المادة ١٢ من قانون العقوبات وعليه فلا يمكن اعتبار هذه اللوائح مما لاتنص على عقوبة كما هى الحالة المنصوص عليها بالفقرة الثانية من المادة ٣٤٨ عقوبات قرار صادر من لجنة المراقبة القضائية بتاريخ ٦ فبراير سنة ١٩٠٧ نمرة ١ قرارات عمومية
Summary (English)
Circular of the Committee of Judicial Surveillance 6 FEBRUARY 1907, No. 1. (P.C. arts 12, 348.) Police offence, meaning of. By providing in certain special regulations that persons found guilty of a breach thereof shall suffer the penalties imposed for police offences it is intended to refer to P.C. art. 12 and such regulations cannot, consequently, be deemed without any prescribed penalty within the meaning of P.C. art. 348 3°.

Circulaire du Comité de Surveillance Judiciaire 6 FÉVRIER 1907, N° 1. (C.P. arts 12, 348.) Peines de simple police — Sens du terme. Les termes de certains Règlements spéciaux qui disposent que les contrevenants aux dits Règlements seront punis des peines de simple police visent purement et simplement l'art. 12 C.P. et l'on ne peut pas, par conséquent, considérer ces Règlements comme ne prévoyant aucune peine dans le sens de l'art. 348 C.P. § 2.
