بما انه عملا بالمادة ٢٣٦ من قانون العقوبات يجوز لزوج المرأة المثبوت عليها الزنا أن يوقف تنفيذ الحكم فله أيضا استنتاجا ان يوقف سير الدعوى قبل الحكم فيها

SUMMARY TRIBUNAL OF MELLAWY 23 March 1907. MM. Mahmoud Nabeeh Effendi (J.); Yassin Ahmad Effendi (State Rep.). STATE REPRESENTATIVE v FATMAH BINT MUHAMMAD ALY (P.C. Arts. 235, 236.) Adultery of wife—Withdrawal of prosecution—Husband, power of. Since, by art. 236 P.C., the husband whose wife has been convicted for adultery is empowered to terminate the operation of the sentence, it must be inferred that, before judgment, he can demand the withdrawal of the prosecution.

Adultère de la femme — Renonciation à la poursuite — Pouvoir du mari. De ce que, d'après l'Art. 236 C.P., le mari dont la femme a été convaincue d'adultère reste maître d'arrêter l'effet de cette condamnation, il y a lieu d'induire qu'avant le jugement il peut requérir l'arrêt de la poursuite.
