اذا تضمن عقد اتفاقا على محل اختصاص وكان ذلك الاتفاق فى فائدة أحد المتعاقدين صرفا جاز له العدول عنه لكنه يعتبر عند ذلك متنازلا عن الاستفادة من الشرط الذى ترك به الطرف الآخر مقدما حق الاستئناف فان التنازل عن حق الاستئناف يعتبر متعلقا ليس الا بحق الاستئناف الذى كان يجوز رفعه عن الحكم اذا صدر من المحكمة التى فى دائرتها محل الاختصاص المتفق عليه

SUMMARY TRIBUNAL OF MELLAWY 8 April 1906. M. Aly Abd-el-Razik Effendi (J.) MUHAMMAD FATHALLAH BEY v. ABD-EL-MAQSOUD SHAHEEN (C.C.C.Pr. Arts. 34, 345.) Election of domicil—Abandonment—Right of appeal. Where one of the parties to a contract has therein made election of domicil exclusively in the interest of the other, such other party is at liberty to waive the election, but he is by so doing deemed to waive the right of benefiting by a clause whereby the first party had deprived himself of the right of appeal. The waiver of the right of appeal is presumed to have been intended to apply to such appeal only as might have lain from the judgment of the Court within the jurisdiction of which election of domicil was made.

TRIBUNAL DE JUSTICE SOMMAIRE DE MILLAWI 8 Avril 1906. M. Aly Abd-el-Razik Effendi (J.). MOHAMED FATHALLAH BEY contre ABD-EL-MAQSOUD SHAHEEN (C.P.C.C. Arts 34, 345). Election de domicile — Renonciation — Droit d'appel. Lorsque, dans un contrat, l'élection de domicile a été stipulée dans le seul intérêt de l'une des parties, celle-ci est libre de renoncer à cette stipulation, mais, en le faisant, elle est censée se désister en même temps, du bénéfice de la clause par laquelle l'autre partie avait renoncé d'avance à son droit d'appel. La renonciation au droit d'appel est présumée viser exclusivement l'appel qui aurait pu être interjeté contre le jugement rendu par le tribunal dans le ressort duquel le domicile a été élu.
