طلب المدعى المدنى من المتهم لما له من الشهرة فى الزايرجة أن يرشده عن رأيه فى المضاربات بالاقطان فأجابه لذلك مشترطا عليه أن يعطيه الثلث مما يربحه مقابل ارشاداته المبنية على كشفه الباطنى فيما يطرأ على السوق من التقلبات فحصل أن صدق المتهم فيما أخبر به وربح المدعى المدنى أرباحا عظيمة دفع منها الى المتهم النصيب المتفق عليه لكن المدعى المدنى المذكور لحقه فيما بعد خسائر نتجت عن مضاربات تالية فقدم للنيابة البلاغ الذى ترتب عليه اقامة الدعوى العمومية الحاضرة على المتهم فحكمت المحكمة الابتدائية بعقابه لكن محكمة الاستئناف برأته وبناء على الطعن فى الحكم بطريق النقض رفضت المحكمة الطعن وقررت مايأتى انه لم ينتج من حكم البراءة ان الخسارة التى لحقت المدعى المدنى سببها نصائح المتهم فوجب النظر فى الاجراآت التى تقدمت تلك الخسارة نعم ان المتهم أوهم المدعى المدنى أن له علما باطنيا يخبر به عن المستقبل ولكن لو فرض ان ارشاداته مبنية على معرفة حقيقية باشغال البورصة لصار الايهام الباطل الذى أوجده عند المجنى عليه عديم الاهمية وفى الجملة فان الطرق الاحتيالية المنسوبة للمتهم لم تكن سوى أنه قد أخبر بالمستقبل وصدق
Summary (English)
COUR OF CASSATION 25 February 1907. MM. Yehia Ibrahim Bey (Pres.); Hanna Nasrallah Bey, Muhammad Said Bey, Hussein Rushdy Bey, Amos (JJ.), Muhammad Safwat Bey (State Rep.) STATE REPRESENTATIVE v. MUHAMMAD ABD-EL-RAHMAN (P.C. 293 ; C.Cr.Pr. Art. 229) Cassation—Misapplication of the law—Obtaining by false pretences—"Clairvoyance." It appeared that the accused, a reputed clairvoyant, had been consulted by the civil claimant with a view to obtaining his advice for the purpose of speculation on the cotton market. The accused had thereupon agreed, in consideration of his receiving a third of the profits, to give the civil claimant advice based on his occult knowledge of the future fluctuations of the market. The predictions of the accused had proved correct and the civil claimant, having thereby realised considerable profits, had paid the accused the share agreed upon. He had, however, lost by subsequent speculation and laid the present information. The accused was convicted in first instance, but acquitted on appeal. Held, that it does not appear from the judgment of acquittal that the losses sustained by the civil claimant were the result of the advice given him by the accused. The question for the Court is therefore confined to the transactions prior to such losses. The accused led the civil claimant to believe that he had an occult power of prediction but, so far as concerns the civil claimant, if it be supposed that the advice was, in reality, based on practical acquaintance with the cotton market, this superstitious belief is immaterial. The device imputed to the accused is, in fact, merely that he foretold future events correctly. The acquittal must therefore be affirmed.

COUR DE CASSATION 25 Février 1907. MM. Yehia Ibrahim Bey (Prés.); Hanna Nasrallah Bey; Mohammed Saïd Bey, Hussein Roushdy Bey, Amos (J.J.); Mohammed Safwat Bey (M. P.). MINISTERE PUBLIC contre MOHAMMED ABD-EL-RAHMAN (C.P. Art. 293 ; C.I.C. Art. 229.) Cassation — Mauvaise application de la loi — Manœuvres frauduleuses — Devin — Escroquerie. La partie civile avait demandé les conseils du prévenu, réputé comme devin, dans le but de spéculer sur le marché des cotons. Par suite, le prévenu consentit, moyennant un tiers des bénéfices réalisés, à donner à la partie civile des conseils fondés sur sa prescience occulte des fluctuations du marché. Les prédictions du prévenu s'étaient montrées exactes, et la partie civile, ayant réalisé en conséquence des bénéfices considérables, lui en avait versé la part convenue. Cependant, il éprouva des pertes, par suite de spéculations ultérieures, et il adressa au parquet la plainte qui motiva la poursuite actuelle. L'accusé fut condamné en première instance, mais acquitté en appel. Sur pourvoi, la Cour de Cassation se prononça dans le sens suivant : Il n'apparaît pas du jugement d'acquittement que les pertes éprouvées par la partie civile aient résulté des conseils du prévenu. La Cour doit donc se borner à examiner les opérations qui précédaient ces pertes. L'accusé avait induit la partie civile à croire qu'il avait une faculté occulte de prédire l'avenir; mais à supposer que les conseils aient été basés, en fait, sur une connaissance pratique du marché des cotons, la croyance superstitieuse de la partie civile n'a pas d'importance. En un mot, la manœuvre frauduleuse imputée au prévenu n'est autre chose que d'avoir prédit l'avenir avec exactitude. Le pourvoi est en conséquence rejeté.
