(Page 53) COURT OF APPEAL 1st JANUARY 1907. MM. Ahmad Affify Bey (Pres.); Marshall, Amos (JJ.). EL SITT ZEYNAB HANEM v. EL SITT ZELIKHAH HANEM (C.C.C.Pr. Art. 34). Jurisdiction—Civil suit—Domicil—Place of payment. The Court of the district wherein the defendant is domiciled has exclusive jurisdiction to try a civil suit upon a contract relating to movable property, notwithstanding the fact that the parties to such contract have agreed that payment shall be made at a place situate in another district.

Compétence — Matière civile — Domicile — Lieu de paiement. Le tribunal du domicile du défendeur est exclusivement compétent en matière mobilière pour juger une instance civile basée sur un contrat, alors même que la convention des parties contractantes fixe un lieu de paiement situé hors de ce domicile.
