المبادئ المستخلصة
نزع الملكية بطريق السلطة الادارية تنفيذا لحكم شرعى هو عمل من أعمال الادارة يخرج عن اختصاص المحاكم الاهلية . فرفع دعوى استرداد عقار أثناء حصول نزع الملكية المذكور لا يوقف اجراآت البيع ولا يكون ميعاد استئناف الحكم الذى يصدر فى الدعوى عشرة أيام من يوم الاعلان .

TRIBUNAL OF CAIRO (Judgment on Appeal). 19 December 1905. MM. Amos (Pres.); Abd-el-Rahman Rida Effendi, Izzat Shoukry Effendi (JJ.). EL SITT EMBARKA BINT IBRAHIM v. EL SITT ARAB BINT SID AHMAD (C.C.C.Pr. Arts 537, 594, 600; O.D. Art. 15; Dec. of 27 May 1897 (Mehkemehs) Art. 92). Expropriation, administrative—Mehkemeh, judgment of—Jurisdiction—Appeal—Time limited. Expropriation by the administrative authorities, in execution of a judgment of the Mehkemeh, is an administrative act without the jurisdiction of the Courts. A claim, by way of revindication, of immovable property which is being thus expropriated does not, consequently, stay the proceedings for sale, nor is the time for appeal from a judgment deciding on such claim limited to ten days from the service thereof.
