المبادئ المستخلصة
نصت المادة «٦/٢» من قانون نمرة ١٣ سنة ١٩٠٥ الخاص بالاحتياطات الواجب اتخاذها لابادة دودة القطن على عقاب «كل من كان مكلفا بمراقبة نزع الأوراق أو نقلها أو احراقها ثم وقع منه أى فعل أو اهمال يمكن أن يترتب عليه عدم احراقها» ويشمل هذا النص كل فعل أو ترك يقع ممن كلف بهذه المراقبة حتى نشأ عنه اعاقة حرق هذه الأوراق فى أى وقت كان سواء أحرقت هذه الأوراق فيما بعد أو لم تحرق

COURT OF CASSATION 16 DECEMBER 1911. MM. Bond (Pres.) ; Aly Zulfikar Bey, Ahmad Zewar Bey, Soudan. Muhammad Saleh Bey (JJ.) ; Muhammad Tewfik Nessim Bey (State Rep.). IBRAHIM AFIFI v. STATE REPRESENTATIVE Cotton-worm, Destruction of—Supervision—Acts punishable. (Law No. 13 of 1905.) Art. 6 § 2 of Law No. 13 of 1905 concerning the measures to be taken for the destruction of the cotton-worm, which provides for the punishment of persons who " charged with the supervision of the stripping of the leaves and their removing and burning, are guilty of any act or negligence which could result in these leaves not being burnt," penalises every act of commission or omission on the part of the person entrusted with such supervision, which could impede, at any stage, the process of burning the leaves, and independently of whether the leaves have, in fact, been burnt or not.

IBRAHIM AFIFI contre MINISTÈRE PUBLIC Ver du coton — Destruction du ver — Surveillance — Actes punissables. (Loi N° 13 de 1905.) L'art. 6 § 2 de la Loi N° 13 de 1905 sur les mesures à prendre pour la destruction du ver du coton, qui punit « celui qui, chargé de surveiller l'effeuillage, le transport, ou le brûlage des feuilles, se rend coupable de tout acte ou négligence qui pourrait avoir pour effet que ces feuilles ne soient pas brûlées » incrimine toute action ou omission de la part de la personne chargée de cette surveillance, qui pourrait entraver, à un moment quelconque, l'incinération des feuilles, et indépendamment du point de savoir si les feuilles ont été ou non effectivement brûlées.
