تشمل عبارة «الامناء على الودائع» الواردة بالمادة «٩٧» عقوبات الأشخاص المعينين لذلك بواسطة الحكومة المصرية مباشرة دون سواهم فلا تشمل حينئذ موظفى مالية حكومة السودان (١) (١) راجع الحكم المنشور أعلاه عدد ٨ رفض الطعن بطريق النقض والابرام المقدم ضد هذا الحكم لخلوه من الاسباب فى ١٤ اكتوبر سنة ١٩١١

ASSIZE COURT OF CAIRO 10 AUGUST 1911. MM. Mohamed Magdi Bey (Pres.); Amos, Amin Aly Bey (JJ.); Osman Fahmy Effendi (State Rep.). STATE REPRESENTATIVE v. ANTOUN ZAMER Misappropriation—Public depositary—Employee of the Sudan Government. (P.C. art. 97.) The words “public depositary” in art. 97 P.C. concerning misappropriation, refer only to persons employed directly by the Egyptian Government, and do not, therefore, comprise an employee of the Finance Department of the Sudan Government. (1) (1) Cf. supra, No. 8. A motion in cassation against this judgment was dismissed for want of grounds on the 11th October 1911.
