لايفصل قاضى البيوع نهائيا إلا فى المسائل المتعلقة باجراءات البيع فاذا رفعت اليه مسائل أخرى (كطلب الحكم ببطلان اعادة البيع على ذمة الراسى عليه المزاد) وجب عليه أن يوقف البيع ريثما تفصل فيها المحكمة المختصة . قارن حكم محكمة طنطا الاستئنافى الصادر فى ٣ فبراير سنة ١٨٩٨ (القضاء سنة خامسة صفحة ٢٢٩) واستئناف ١٠ يونيه سنة ١٩١٢ (المجموعة الرسمية السنة الثالثة عشرة عدد ١٣٢/١) .

Expropriation of immovables—Proceedings for sale—Jurisdictio[n] of judge appointed to conduct sale. (Art. 602 C.C.C.Pr.) The judge appointed to conduct a sale ha[s] jurisdiction to decide finally questions relatin[g] to the formalities of the sale only. When othe[r] questions are raised (such, for instance, as an application for cancelling a re-sale at the risk of a defaulting purchaser) he must stay the sale proceedings until the matter is decided by the competent Court. Le juge commis à l'adjudication ne statue sans recours que sur les questions relatives aux formalités de l'adjudication.
