المبادئ المستخلصة
(١) أنه وان كانت الظروف السياسية هى التى دعت الى سنّ المادة ٤٧ مكررة من قانون العقوبات إلا أن هذه المادة تنطبق على الاتفاقات الجنائية التى يكون الغرض منها ارتكاب جرائم عادية كما تنطبق على الاتفاقات الجنائية ذات الأغراض السياسية . (٢) لابد لوجود جريمة الاتفاق الجنائى المنصوص عليها فى المادة ٤٧ مكررة من قانون العقوبات أن يكون الاتفاق منظما على نوع ما وأن يستمر قائما مدّة من الزمن (١) .
