COURT OF APPEAL. 20 March 1917. MM. Halton (Pres.); Ahmad Mussa Pasha, Mustapha Fathy Bey (JJ.). PRINCE IBRAHIM HASSAN AND OTHERS v. MINISTRY OF FINANCE. Extinctive prescription—Date from which it runs—Warranty of the thing sold. (Arts. 208, 300 C.C.) The vendor's warranty of the thing sold, in the case of eviction, is barred by the lapse of fifteen years from the date of the eviction and not from the date of the sale. (Cf. Art. 2257 of the French Civil Code.)

Prescription extinctive — Point de départ — Vente — Garantie de la chose vendue. (Art. 208, 300 C.C.) La garantie, par le vendeur, de la chose vendue, en cas d'éviction se prescrit, par quinze ans à partir de l'éviction et non à partir de la vente (cf. Art. 2257 du Code Civil Français).
