المبادئ المستخلصة
حظرت المادة العاشرة من القرار الوزارى المؤرخ ٨ سبتمبر سنة ١٨٨٩ اقامة أى بناء على الأرض اللازم نزع ملكيتها من تاريخ صدور أمر عال باعتماد خط التنظيم غير أنها لم تمنع اجراء الأعمال اللازمة لصيانة الأبنية القائمة من قبل حتى تنزع ملكيتها . ولذلك يجوز لمالك بناء خارج عن خط التنظيم أن يجرى أعمال الترميم الضرورية لجعل البناء صالحا للانتفاع به حتى تنزع ملكيته ولكن يشترط فى هذه الترميمات أن لايكون من شأنها زيادة النفقة التى تتحملها خزينة الحكومة . أنظر استئناف مختلط ٢٥ أبريل سنة ١٨٩٤ (مجلة التشريع والقضاء السنة السادسة صفحة ٣٢١) واستئناف مختلط أول مارس سنة ١٩٠٥ (مجلة التشريع والقضاء السنة السابعة عشرة صفحة ١٣٩) .

COURT OF APPEAL. 5 April 1914. MM. Ahmad Zulfikar Bey (Pres.); Ahmad Ragheb Badr Bey, McBarnet (JJ.); Muhammad Zaki el Abrashi Effendi (State Rep.). STATE REPRESENTATIVE v. AHMED BEY RAGHEB. Tanzim—Alignment—Buildings lying outside the alignment—Repairs. (Decree of August 26, 1889—Order of the Public Works Department of September 8, 1889). Article 10 of the Ministerial Order of September 8, 1889, which prohibits, as from the date of promulgation of a decree approving a plan of alignment, the erection of any buildings on the ground which it is intended to expropriate, does not prohibit repairs of existing buildings pending expropriation. The owner of a building lying outside the Tanzim alignment may, therefore, carry out the repairs necessary to keep the premises in a fit condition to be used until the expropriation. Such repairs, however, must not be of such a nature as to entail an increase of the charge on the public treasury. See, App. Mixte, April 25, 1894 (B.L.J. Tanzim—Alignement—Immeubles en dehors de l'alignement—Travaux d'entretien. (Décret du 26 août 1889—Arrêté du Ministère des Travaux Publics du 8 septembre 1889). L'article 10 de l'arrêté ministériel du 8 septembre 1889, qui interdit, dès la promulgation du décret sanctionnant un plan d'alignement, toute construction sur le terrain destiné à l'expropriation, ne défend pas, en attendant cette expropriation, l'entretien des constructions existantes. Le propriétaire d'un immeuble situé en dehors de l'alignement du Tanzim peut donc faire les travaux de réparation qui sont nécessaires pour permettre l'usage de l'immeuble jusqu'à l'expropriation ; toutefois, ces travaux ne peuvent être de nature à entraîner une aggravation de charge pour le trésor public.
