لا يعاقب مالك الأرض المصابة بدودة القطن أو مستأجرها على إهماله فى مراقبة إبادة الدودة بمقتضى المـادة ٦ فقرة ٢ من القانون نمرة ١٣ لسنة ١٩٠٥ إلا اذا كانت السلطة الادارية قد عرضت عليـه — طبقا للمـادة ٣ من القانون المشار اليه — القيام بهذا العمل قبله .

STATE REPRESENTATIVE v. EL SAYED METWALLI ISMAIL. Cotton-worm — Destruction — Negligence — Landlord or tenant — Criminal responsibility. (Law No. 13 of 1905, amended by Law No. 9 of 1910). The landlord or tenant of land which is infected with cotton-worm is not punishable under Article 6 § 2 of Law No. 13 of 1905, for neglecting to supervise the destruction of the worm, unless he has, at the request of the administrative authorities, consented, in accordance with Article 3 of the law in question, to be responsible for carrying out such work.

MINISTÈRE PUBLIC contre EL SAYED METWALLI ISMAIL. Ver du coton — Destruction — Négligence — Propriétaire ou locataire — Responsabilité pénale. (Loi n° 13 de 1905, modifiée par la Loi n° 9 de 1910). Le propriétaire ou locataire d'un terrain infecté du ver du coton ne peut être puni, en vertu de l'article 6 § 2 de la Loi n° 13 de 1905, pour avoir négligé de surveiller la destruction du ver, que si, conformément à l'article 3 de la dite loi, il avait accepté, sur la demande des autorités administratives, de se charger lui-même de cette opération.
