المبادئ المستخلصة
يلزم أن يضاف على ميعاد الاستئناف مواعيد المسافة بين محل المستأنف الذى أعلن له فيه الحكم ومحل المحكمة الاستئنافية المطلوب الحضور أمامها للفصل فى الاستئناف . ولا محل لزيادة هذه المواعيد باحتساب مسافة طريق أخرى بين محل اقامة المستأنف عليه ومحل المحكمة . COURT OF APPEAL. 13 FEBRUARY 1923. MM. Percival (Pres.); Fawzy El Motey Bey, Muhammad Mostafa Bey (JJ.). EL SHEIKH GAD OMAR EL FIKKY v. EL MASRY EL SAADY BEY. Appeal — Time-limit — Delay of Distance—(Arts. 354 and 17 C.C.C.Pr.) The time limited for lodging appeal should be increased by adding the time allowed for distance between the domicile of the appellant, where the judgment is served, and the seat of the tribunal before which the appeal is brought. Such time-limit, however, should not be increased by adding the time allowed for distance between the domicile of the respondent and the seat of the Court above-said. Cf. Le délai d'appel doit être augmenté de délai de distance entre le domicile de l'appelant où la signification du jugement a été faite et le lieu où siège le tribunal d'appel.
