المبادئ المستخلصة

SUMMARY TRIBUNAL OF EL LABBAN. 16 MAY 1921. MM. Abdel Latif Ghorbal Eff. (J.); Ibrahim Yehia Eff. (State Rep.). STATE REPRESENTATIVE. v. SANIAH BENT IBRAHIM AND ANOTHER. Adultery of wife—Death of wife—Effect as regards paramour.—(Arts. 235, 236 P.C.) Contrary to the general rule, according to which the death of the principal offender is not a bar to the institution of criminal proceedings against the accessory, the death of an adulterous wife, occurring before final judgment, extinguishes the public action as regards the paramour. Adultère de la femme—Décès de la femme—Effet en ce qui concerne le complice.—(Art. 235, 236 C.P.) Contrairement à la règle générale selon laquelle le décès de l'auteur principal ne met pas obstacle à l'exercice de l'action publique contre le complice, le décès de la femme adultère, survenu avant le prononcé du jugement définitif, éteint l'action publique à l'égard du complice.
