المبادئ المستخلصة
ان المبانى التى يقيمها شخص على عقار موقوف باذن من ناظر الوقف تعتبر ملكا قائما بذاته وتكون خاضعة لأحكام الكدك المقررة فى الشريعة الاسلامية . ولمن أقام هذه المبانى أن يتصرف فيها بالبيع أو الهبة كما أن ملكيتها تنتقل بالميراث عنه وكذلك فى حالة هدمها تكون الأنقاض ملكا لصاحب الكدك أو لمن تلقى حق الملكية عنه . COURT OF APPEAL. 12 DECEMBER 1921. MM. Hafez Lutfy Bey (Pres.); Rafferty, Aly Salem Bey (JJ.). WAKF OF DEIR EL MUKHALLIS v. MINISTRY OF WAKFS. Wakf—Kadak—Conditions—Effect. Buildings erected by a person upon an immovable belonging to a Wakf, by permission of the Nazir of the Wakf, constitute a separate property, as being a Kadak under the rules of Muhammadan Law. The person who has erected such buildings may sell or give them to a third party; and they are transmissible by way of succession. In case of demolition of the buildings, the materials belong to the owner of the Kadak or to his successor in title. COUR D'APPEL. 12 DÉCEMBRE 1921. MM. Hafez Loutfi Bey (Prés.); Rafferty, Ali Salem Bey (CC.). WAKF DU DEIR EL MOUKHALLISS contre MINISTÈRE DES WAKFS. Wakf—"Kadak"—Conditions—Effet. Constituent un bien à part, comme étant un Kadak selon les règles du droit musulman, les constructions édifiées par une personne dans un immeuble Wakf, avec l'autorisation du Nazir du Wakf. Celui qui a fait pareilles constructions peut les vendre ou les donner à un tiers; et elles sont transmissibles par succession.
