SUMMARY TRIBUNAL OF EL AYAT. 30 MARCH 1921. M. Guindy Abdel Malek Bey (J.). MANZOOR HEMEIDA v. AHMAD AHMAD SOLIMAN. Possessory action — Admissibility — Conditions — Prescription — Interruption — Criminal proceedings.—(Art. 26, 3° C.C.C.Pr.) A possessory action is only admissible if brought within a year of the commission of the acts upon which it is founded. The action is prescribed by the lapse of the said period, and the prescription is not interrupted by the fact of criminal proceedings having been instituted against the defendant in the possessory action. L'action possessoire n'est recevable que si elle a été introduite dans l'année du prétendu trouble de la possession. L'action est prescrite par l'expiration de ce délai, sans que l'on puisse arguer que la prescription a été interrompue par des poursuites pénales dirigées contre l'auteur du trouble.
